RESOLUTION NO. 23-1372 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON UPDATING <br /> RESOLUTION NO. 93-68 FOR PARKING CITATION PENALTIES TO NAME NEW <br /> ADMINISTRATIVE HEARING OFFICERS AND APPROVE THE POLICY FOR <br /> PAYMENT ALTERNATIVES <br /> WHEREAS, in 1993, the City Council adopted administrative procedures for processing <br /> parking citations in Resolution No. 93-68; and <br /> WHEREAS, in the intervening decades, California law has been amended and now allows <br /> options for fine payments that include: community service, installment plans, and reductions and <br /> waivers due to financial hardship (see Cal. Vehicle Code §40215); and <br /> WHEREAS, the City needs to update personnel positions serving as administrative <br /> hearing officers, and seeks to incorporate the new payment alternatives under state law. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the update of the parking citation administrative procedures has <br /> no possibility to have a significant effect on the environment per Title 14 California Code of <br /> Regulations (CEQA Guidelines) §15061(b)(3). <br /> SECTION 2. Amends Section 1, Item 2 of Resolution No. 93-68 and names the Deputy <br /> City Manager and Assistant City Manager as Administrative Hearing Officers. <br /> SECTION 3. Adopts the policy for Payment Alternatives for Parking Citation Penalties <br /> as provided in the attached Exhibit A. <br /> SECTION 4. This resolution shall be effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on March 21, 2023. <br /> I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on March 21, 2023, by the <br /> following vote: <br /> Ayes: Councilmembers Arkin, Balch, Nibert, Testa, Mayor Brown <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> J�clyn K ong ity Clerk <br /> APPROVED AS TO FORM: <br /> Daniel G.
