northbound on-ramp project as proposed, which in turn allowed Caltrans to engage in <br /> the on-ramp's lengthy design and permitting process. <br /> At its meeting on July 19, 2022, the City Council approved purchase agreements with <br /> seven property owners on Johnson Drive, including the aforementioned Costco <br /> purchase agreement. These seven agreements, including the title insurance and <br /> escrow fees, totaled $1,320,239. The right-of-way acquired by the seven purchase <br /> agreements was needed for the four mitigation measures making up the JDEDZ Street <br /> Improvements as defined in the 2018 Agreement. All seven of these transactions have <br /> since been finalized and the grant deeds for the right-of-way have been recorded. <br /> Separating the cost of the right-of-way acquired to construct the "JDEDZ Street <br /> Improvements" from the cost of the right-of-way acquired to construct the "Stoneridge 1- <br /> 680 On-Ramp" is important because the 2018 Agreement requires Costco to reimburse <br /> the City 50 percent of the cost of the right-of-way needed for the "JDEDZ Street <br /> Improvements," while the City must cover the total cost for the "Stoneridge 1-680 On- <br /> Ramp" right-of-way. <br /> When the City Council approved the seven purchase agreements on July 19, 2022, staff <br /> informed the Council that negotiations with two of the Johnson Drive property owners <br /> north of the Costco property had been unsuccessful, but that the right-of-way from these <br /> two properties was only needed for the purpose of constructing a sidewalk and <br /> landscaped parkway and not for roadway widening purposes. Staff noted that because <br /> the right-of-way was not needed for roadway widening, the "JDEDZ Street <br /> Improvements" could be mostly constructed, but there would be gaps in the proposed <br /> sidewalk and landscaped parkway across the two property frontages. City Council <br /> approved moving forward with the construction but directed staff to continue <br /> negotiations with the goal of acquiring the rights needed to complete sidewalk and <br /> parkway improvements. <br /> Staff also reported at the July 19, 2022, City Council meeting, and as reflected in the <br /> agenda report, the right-of-way needed from the two remaining properties should cost <br /> an estimated amount of $115,000 each, or $230,000 in total. The estimated cost was <br /> based on the land appraisals of the two properties, and the land appraisals and the final <br /> negotiated prices of the six properties as reflected in the purchase agreements <br /> presented to City Council for approval at the meeting. (No appraisal was prepared for <br /> the property rights needed across the Costco property frontage.) <br /> DISCUSSION <br /> Staff has now successfully completed negotiations with the two remaining Johnson <br /> Drive property owners. Copies of the purchase agreements for 7116 Johnson Drive and <br /> 7080 Commerce Circle, each signed by the respective property owner, are attached <br /> (7080 Commerce Circle has an address on Commerce Circle, but the right-of-way <br /> needed is along the Johnson Drive side of the property). The final negotiated purchase <br /> price for the two properties, including estimated title insurance and escrow fees, totals <br /> $229,762.
