The proposed project <br />would also be required to follow procedures outlined in Section 7050.5 of the California Health and <br />Safety Code and Public Resources Code Section 5097.98 as well as Prior EIR MM 4.D-4. Therefore, <br />there are no environmental effects that are peculiar to the proposed project or the parcels on which <br />the proposed project would be located. Impacts would be less than significant, and the proposed <br />project would not result in a new or more severe adverse impact that was not previously identified <br />in the Prior EIR. <br />Tribal Cultural Resources <br />Additional Checklist questions were added to the CEQA Guidelines Appendix G Checklist in 2016 and <br />did not exist at the time the Prior EIR was certified. These checklist questions address TCRs in its own <br />topical section and considered whether the proposed project would cause a substantial adverse <br />change in the significance of a tribal cultural resource, defined in Public Resources Code Section <br />21074 as either a site, feature, place, cultural landscape that is geographically defined in terms of the <br />size and scope of the landscape, sacred place, or object with cultural value to a California Native <br />American tribe, and that is: <br />• Listed or eligible for listing in the California Register of Historical Resources, or in a local <br />register of historical resources as defined in Public Resources Code Section 5020.1(k), or <br />• A resource determined by the lead agency, in its discretion and supported by substantial <br />evidence, to be significant pursuant to criteria set forth in subdivision (c) of Public <br />Resources Code Section 5024.1. In applying the criteria set forth in subdivision (c) of <br />Public Resource Code Section 5024.1, the lead agency shall consider the significance of <br />the resource to a California Native American tribe. <br /> <br />d) e) Tribal Cultural Resources <br />Prior EIR Conclusions <br />This checklist question did not exist when the Prior EIR was certified and was not discussed in the <br />Prior EIR. <br />Analysis of Proposed Project <br />The results from the NWIC records search indicated that no prehistoric cultural resources have been <br />recorded within the project site or its 0.5-mile search radius, additionally, the pedestrian survey <br />failed to locate or identify any cultural resources. However, On December 9, 2022, FCS staff sent a <br />letter to the NAHC in an effort to determine whether any sacred sites are listed on its Sacred Lands <br />File for the project site. On November 15, 2022, FCS received a response from the NAHC stating that <br />the results of the Sacred Lands File search were positive, indicating that there may be TCRs within <br />the project site or its 0.5 mile search radius. The NACH letter recommended reaching out to a list of <br />tribal representatives to obtain additional information. <br />To ensure that all Native American knowledge and concerns over potential TCRs that may be <br />affected by the proposed project are addressed, a letter containing project information and
