Many of the potential sites for rezoning <br />are currently developed and/or surrounded by existing development and provide habitat only for <br />urban wildlife and birds. Species with the potential to occur within the proposed project (e.g., Site 3) <br />are discussed in further detail below. <br />Nesting Birds <br />The Prior EIR found that the removal of any trees or other vegetation could result in direct losses of <br />nesting habitat, nests, eggs, nestlings, of special-status birds. However, it was determined that these <br />impacts would be avoided or mitigated at less than significant levels through the implementation of <br />MM 4.C-1a. <br />Analysis of Proposed Project <br />As mentioned above, most of the potential sites for rezoning do not provide suitable habitat for <br />special-status species as they are currently developed and/or surrounded by existing development. <br />The proposed project site is currently composed of an asphalt parking lot with 810 parking spaces. <br />The parking lot contains landscaped parking islands with 169 trees, many of which are Heritage Trees <br />as defined by the City’s Tree Preservation Ordinance.33 The site is relatively flat with a gentle slope to <br />the southeast to facilitate drainage and runoff. The project site is surrounded by Stoneridge Mall <br />commercial and parking facilities to the north and west, Stoneridge Mall Road (east), office and <br />parking facilities to the east; and Stoneridge Mall Road (south) and commercial space to the south. <br />The proposed project would not result in new or more severe impacts than those identified in the <br />Prior EIR. The numerous ornamental trees within the project site could provide suitable habitat for a <br />variety of species of nesting birds. Construction activities that occur during the avian nesting season <br />(generally February 1 to August 31) could disturb nesting sites for bird species protected under the <br />Fish and Game Code or Migratory Bird Treaty Act (MBTA). The removal of trees during the nesting <br />season could result in direct harm to nesting birds, while noise, light, and other man-made <br />disturbances may cause nesting birds to abandon their nests resulting in a significant impact. <br />Implementation of MM BIO-4.C-1a would require the project applicant to implement avoidance and <br />minimization measures to ensure that projects impacts on nesting birds are reduce to a level of less <br />than significant. Therefore, there are no environmental effects that are peculiar to the proposed <br />project or the parcels on which the proposed project would be located. Because there would be no <br />impacts, the proposed project would not result in a new or more severe adverse impact that was not <br />previously identified in the Prior EIR. <br />b) Adverse Effect on Any Riparian Habitat or Other Sensitive Natural Community <br />Prior EIR Conclusions <br />This topic is discussed under Impact 4.C-2 of the Prior EIR, which concluded that the City contains <br />numerous waterways (e.g., Arroyo del Valle) that support riparian corridors that could serve as <br /> <br />33 City of Pleasanton.
