BACKGROUND <br /> Senate Bill 330 Preliminary Review <br /> On October 9, 2019, Governor Newsom signed the Housing Crisis Act of 2019 (HCA) <br /> into law, commonly known as Senate Bill 330 (SB 330) to respond to the California <br /> housing crisis. On September 16, 2021, Governor Newsom signed Senate Bill 8, which <br /> is an extension of the HCA, extending the provisions of SB 330 to sunset on January 1, <br /> 2030. SB 330 establishes a statewide housing emergency and creates new State law <br /> focused on the production and preservation of housing. SB 330 aims to expedite and <br /> increase certainty in the development process with changes to the Housing <br /> Accountability Act and Permit Streamlining Act. The bill changes certain aspects of the <br /> development review process, including but not limited to: <br /> • Provides an optional vesting opportunity for housing development projects <br /> through the Preliminary Application process; <br /> • Establishes an historic site determination at the time the Preliminary Application <br /> is deemed complete; <br /> • Limits public hearings to a maximum of five once an application is deemed <br /> completed; and <br /> • Establishes housing replacement and tenant relocation requirements. <br /> The provisions of SB 330 are applicable to all housing development projects that require <br /> discretionary review, or review and approval by the Zoning Administrator, Planning <br /> Commission or City Council before an applicant can apply for a building permit. Housing <br /> development projects include any residential development, mixed-use projects with a <br /> minimum of approximately two-thirds of square footage designated for residential units, <br /> and transitional or supportive housing. SB 330 provides an optional vesting opportunity <br /> for housing development projects, which "freeze" the policies, standards, and fees in <br /> effect when the Preliminary Application is submitted and requires the formal application <br /> to be submitted within 180 days from submittal of the Preliminary Application. The bill <br /> allows cities to charge a permit processing fee for SB 330 preliminary applications. <br /> Housing Site Compliance Review <br /> On January 26, 2023, the City Council adopted the 6th Cycle Housing Element and <br /> associated Objective Design Standards. The Housing Element includes Program 4.8, a <br /> streamlined review process for development of housing sites, referred to as "Housing <br /> Site Compliance Review". This process is spelled out in more detail in the Objective <br /> Design Standards. Pursuant to the newly established process, large housing site <br /> projects of over 50 units (exclusive of Accessory Dwelling Units/Junior Accessory <br /> Dwelling Units) would be subject to review and action by the Planning Commission <br /> (PC), whereas small housing site projects (up to 50 units) would be subject to review <br /> and action by the Zoning Administrator (ZA). In both instances (PC or ZA), review and <br /> action would be limited to conformance analysis of the proposed housing site projects <br /> with the adopted Objective Design Standards. Public notice would be required for both <br /> the ZA and PC review, and, as with all approval actions specified in the Pleasanton <br /> Municipal Code, both allow the ability to "call up" a project for review by the PC or City <br /> Council, and the ability for an appeal to be filed with the City Clerk. <br /> Page 2 of 3 <br />
