Tribal Cultural Resources <br /> The project is subject to compliance with Assembly Bill (AB) 52 (California Public <br /> Resources Code Section 21074), which requires consideration of impacts on tribal <br /> cultural resources as part of the CEQA process and requires the CEQA lead agency to <br /> notify any groups (who have requested notification) who are traditionally or culturally <br /> affiliated with the geographic area of the project. AB 52 requires lead agencies to <br /> consult with California Native American Tribes that request such consultation prior to <br /> completing the environmental review in accordance with CEQA. AB 52 provides for the <br /> inclusion of California tribes' expertise regarding cultural resources and a process for <br /> governing bodies to incorporate tribal knowledge into the CEQA review process. <br /> Accordingly, the City sent notification letters to eight Native American tribes who are <br /> traditionally or culturally affiliated with the project area. None of the tribes have <br /> requested consultation and none have identified any concerns regarding the known or <br /> potential presence of tribal cultural resources in the project vicinity. Additionally, Dudek <br /> contacted the NAHC on February 19, 2021, to request a search of the Sacred Lands <br /> File. The NAHC responded on March 2, 2021, indicating that the search failed to identify <br /> any Native American resources in the vicinity of the project and provided a list of <br /> individuals and organizations to contact that may have additional information. <br /> PUBLIC NOTICE <br /> The Initial Study and the proposed Mitigated Negative Declaration were circulated for <br /> public review on April 30, 2022, for 30 days, pursuant to CEQA Guidelines Section <br /> 15073(a). The City provided public notice to all residents within 1,000 feet of the <br /> proposed project site at the beginning of the public review period and a draft Initial <br /> Study was routed to State agencies through the Office of Planning and Research under <br /> a Notice of Completion. The City posted a notice of intent to adopt a mitigated negative <br /> declaration on the City's website and provided the notice of intent to the County Clerk- <br /> Recorder's office and via direct mailings and emails to other stakeholders, local <br /> agencies, and other parties that have expressed interest in the project. <br /> No comments were received. <br /> The recommended mitigation measures from the MND were incorporated into the trail <br /> construction documents. <br /> DISCUSSION <br /> The City finds that, with the implementation of the identified mitigation measures, there <br /> is no substantial evidence that the proposed project would have a significant effect on <br /> the environment. The mountain bike trail project is identified in the City's Trails Master <br /> Plan and the proposed alignment and features are consistent with the Trails Master <br /> Plan. Therefore, the City has prepared a resolution adopting an MND for the Augustin <br /> Bernal Mountain Bike Trail Project. Staff recommends the City Council adopt the <br /> resolution adopting the MND for the Augustin Bernal Mountain Bike trail. <br /> Page 6 of 7 <br />
