RESOLUTION NO. 23-1354 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A SUBLICENSE AGREEMENT WITH THE EAST BAY REGIONAL PARK <br /> DISTRICT FOR A SECTION OF THE IRON HORSE TRAIL LOCATED BETWEEN <br /> SANTA RITA ROAD AND VALLEY AVENUE <br /> WHEREAS, Alameda County owns the former railroad corridor between Interstate 580 <br /> and Valley Ave where the County has given the East Bay Regional Park District a license to allow <br /> the District to operate the Iron Horse Trail; and <br /> WHEREAS, when the City approved the Ponderosa Homes project in 2006, that <br /> developer built a trail and related improvements along an approximately one-mile segment of the <br /> Iron Horse Trail between Santa Rita Road and Valley Avenue; and <br /> WHEREAS, while the City and District have had an informal understanding regarding <br /> maintenance responsibilities for that segment of the Iron Horse Trail built by the developer, the <br /> City and District have agreed to formalize this maintenance responsibilities. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the shared maintenance responsibilities provided for in the <br /> Sublicense Agreement have no possibility to have a significant effect on the environment per Title <br /> 14 California Code of Regulations §15061(b)(3). <br /> SECTION 2. Approves the Iron Horse Trail Sublicense Agreement with the East Bay <br /> Regional Parks District, as shown in the attached, and authorizes the City Manager to execute all <br /> necessary documents. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on January 17, 2023. <br /> I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on January 17, 2023, by the <br /> following vote: <br /> Ayes: Councilmembers Arkin, Balch, Nibert, Testa <br /> Noes: None <br /> Absent: Mayor Brown <br /> Abstain: None <br /> Jocy Kwong Pty erk <br /> APPR VED AS TO FORM: <br /> Daniel G.
