City of Pleasanton 2023-2031 (6th Cycle) Housing Element Update <br />CEQA Findings of Fact and Statement of Overriding Considerations <br /> <br /> <br />FirstCarbon Solutions 131 <br />Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480022/FOF/21480022 Pleasanton Housing Element FOF.docx <br /> (xi) For documentary and informational purposes, all locally-adopted land use plans and <br />ordinances, including, without limitation, general plans, specific plans and ordinances, <br />master plans together with environmental review documents, findings, mitigation <br />monitoring programs, and other documentation relevant to planned growth in the area; <br />(xii) Any other written materials relevant to the lead agency’s compliance with this division or to <br />its decision on the merits of the Project, including any drafts of any environmental <br />document or portions thereof, which have been released for public review, and copies of <br />studies or other documents relied upon in any environmental document prepared for the <br />Project and either made available to the public during the public review period or included <br />in the lead agency's files on the Project, and all internal agency communications, including <br />staff notes and memoranda related to the Project or to compliance with this division; <br />(xiii) The full written record before any inferior administrative decision-making body whose <br />decision was appealed to a superior administrative decision-making body prior to the filing <br />of litigation; and <br />(xiv) Any additional items not included above if otherwise required by law. <br /> <br />Recirculation Not Required <br />During the public review period after the Draft Program EIR was published, the lead agency received <br />certain additional information. Lead agency staff and consultants involved in preparing the various <br />studies, reports and analyses included in the Program EIR have also presented additional information <br />since the publication of the Draft Program EIR. Some of this information was contained in comments <br />submitted on the Draft Program EIR, and in responses to those comments contained in the Final <br />Program EIR. Other information was presented at or before public meetings/hearings on the <br />Program EIR. The Program EIR incorporates additions, clarifications, modifications, and other <br />changes, in response to comments and as determined appropriate by lead agency staff and required <br />under CEQA. <br />The lead agency has considered all relevant information including the opinions and comments of <br />interested agencies, organizations and individuals. The lead agency finds that the additional <br />information does not show that any of the following situations requiring recirculation identified in <br />CEQA Guideline 15088.5 have occurred: <br />1. A new significant environmental impact that would result from the Housing Element Update <br />(or any alternative) or from a new mitigation measure proposed to be implemented. <br />2. A substantial increase in the severity of an environmental impact would result unless <br />mitigation measures are adopted that reduce the impact to a level of insignificance. <br />3. A feasible project alternative or mitigation measure considerably different from others <br />previously analyzed would clearly lessen the significant environmental impacts of the project <br />(or an alternative), but the project's proponents decline to adopt it. <br />4. The Draft Program EIR was so fundamentally and basically inadequate and conclusory in <br />nature that meaningful public review and comment were precluded.
