Accordingly, the City finds that, pursuant to Public Resources Code <br />Section 21081(a)(1) and State CEQA Guidelines Section 15091(a)(1), changes or alterations have <br />been required in, or incorporated into, the Housing Element Update that mitigate or avoid the <br />potentially significant impacts as identified in the Program EIR. Therefore, impacts associated with <br />hazardous resources would be less than significant with mitigation incorporated. <br />Impact HAZ-4: Development consistent with the Housing Element Update, rezonings, and General <br />Plan and Specific Plan Amendments could be located on a site which is included on a list of <br />hazardous materials sites compiled pursuant to Government Code Section 65962.5 and, as a result, <br />could create a significant hazard to the public or the environment (Draft Program EIR, Page 3.8-32). <br />Findings: Less than significant impact with mitigation incorporated (Draft Program EIR, Page <br />3.8-34). Changes or alterations have been required in, or incorporated into, the <br />Housing Element Update which avoid or substantially lessen the significant <br />environmental effects as identified in the Program EIR. (State CEQA Guidelines, § <br />15091(a)(1)) <br />Mitigation Measures <br />Implement MM HAZ-2. <br />Facts in Support of Findings: As described in Impact HAZ-2, several of the potential development <br />sites are near identified contamination sources that have not been fully remediated; in addition, <br />several former hazardous waste sites that have been fully remediated exist near potential <br />development sites. If a potential site for rezoning is suspected to contain hazardous materials, <br />further site characterization and/or remediation work would be required to ensure that construction <br />activities would not expose people or the environment to adverse effects, as required by MM HAZ-2. <br />Land uses and structures intended for human occupancy would not be permitted by the overseeing <br />agency (e.g., ACEH or RWQCB) on sites where the potential threat to human health or the <br />environment is present (Draft Program EIR, Page 3.8-32–34). <br />The City finds that MM HAZ-2 is feasible, is adopted, and will further reduce impacts associated with <br />hazards and hazardous materials. Accordingly, the City finds that, pursuant to Public Resources Code <br />Section 21081(a)(1) and State CEQA Guidelines Section 15091(a)(1), changes or alterations have <br />been required in, or incorporated into, the Housing Element Update that mitigate or avoid the <br />potentially significant impacts as identified in the Program EIR. Therefore, with implementation of <br />MM HAZ-2 and compliance with applicable federal, State, and local laws, as well as compliance with <br />plans and regulations, as described above, impacts related to the creation of a hazard to the public <br />or environment would be less than significant with mitigation. <br />1.6.5 - Noise <br />Impact NOI-1: Development consistent with the Housing Element Update, rezonings, and General <br />Plan and Specific Plan Amendments could generate a substantial temporary or permanent increase <br />in ambient noise levels in the vicinity of the potential sites for housing in excess of standards
