Portions of the <br />City lying in the flat valley have a low sensitivity for prehistoric sites, except along drainages. <br />However, the hills to the west and south, especially around springs and creeks, have a relatively high <br />sensitivity for containing prehistoric sites. Most of the potential sites for rezoning are in the flat <br />valley area on parcels that have been previously disturbed with development. However, Sites 1 <br />(Lester), 22 (Merritt), and 27 (PUSD-Vineyard) may have only been minimally disturbed in the past <br />and are not within the flat valley area. As discussed in Impact CUL-1, the General Plan includes <br />policies and programs specifically designed to address potential impacts to archaeological resources, <br />including Goal 4 of the Open Space and Conservation Element, Policy 5, and Program 5.1, Program <br />5.2, and Program 5.3. With respect to Site 27 (PUSD-Vineyard), the Vineyard Avenue Corridor <br />Specific Plan includes Policy 1 (see Impact CUL-1). Development applications would be reviewed by <br />the City for compliance with the policies and programs of the General Plan as well as the regulations <br />of the Municipal Code related to archaeological resources. Compliance with applicable current <br />federal, State, and local laws as well as General Plan and Vineyard Avenue Corridor Specific Plan <br />policies and programs and the regulations of the Municipal Code would ensure that future <br />development projects are appropriately reviewed and designed in terms of potential impacts to <br />archaeological resources. Consistent with the General Plan policies and programs, individual <br />development projects would be required to undergo project-specific environmental review (Draft <br />Program EIR, Page 3.4-21–22). <br />Potential Effect <br />Impact CUL-3: Development consistent with the Housing Element Update, rezonings, and General <br />Plan and Specific Plan Amendments would not disturb human remains, including those interred <br />outside of formal cemeteries. (Draft Program EIR, Page 3.4-22). <br />Findings: Less than significant impact. <br />Facts in Support of Findings: Excavation and construction activities consistent with the Housing <br />Element Update may uncover human remains that may not be marked in formal burial locations. The <br />General Plan includes policies and programs intended to conserve and reduce impacts to <br />archaeological resources, including human remains. Goal 4 of the Open Space and Conservation <br />Element requires the designation, preservation, and protection of archaeological resources, <br />including burial sites. Program 5.3 requires the cessation of all construction and grading activities <br />within the vicinity of any discovered prehistoric or historic artifacts, including burial sites, until any <br />such find is evaluated by a qualified professional Archaeologist and appropriate mitigation is <br />approved by the City. With respect to Site 27 (PUSD-Vineyard), as set forth by Policy 2 in the <br />Vineyard Avenue Corridor Specific Plan, in the event of discovery or recognition of any human <br />remains on-site, there shall be no further excavation or disturbance of the site or any nearby area <br />reasonably suspected to overlie adjacent remains until the county coroner has determined, in <br />accordance with any laws concerning investigation of the circumstances, the manner or the cause of <br />death and has made recommendation concerning treatment and disposition of the human remains <br />to the person responsible for the excavation or to his or her authorized representative.
