City of Pleasanton 2023-2031 (6th Cycle) Housing Element Update <br />CEQA Findings of Fact and Statement of Overriding Considerations <br /> <br /> <br />FirstCarbon Solutions 1 <br />Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480022/FOF/21480022 Pleasanton Housing Element FOF.docx <br />CEQA FINDINGS OF FACT AND STATEMENT OF OVERRIDING <br />CONSIDERATIONS <br />1.1 - Introduction <br />The State CEQA Guidelines promulgated pursuant to the California Environmental Quality Act (CEQA) <br />provide: <br />No public agency shall approve or carry out a project for which an EIR has been <br />completed which identifies one or more significant environmental effects of the <br />project unless the public agency makes one or more written findings for each of <br />those significant effects, accompanied by a brief explanation of the rationale for <br />each finding. The possible findings are: <br />(a) Changes or alterations have been required in, or incorporated into, the project <br />which avoid or substantially lessen the significant environmental effect as <br />identified in the Final EIR (hereinafter referred to as “finding (1)”). <br />(b) Such changes or alterations are within the responsibility and jurisdiction of <br />another public agency and not the agency making the finding. Such changes <br />have been adopted by such other agency or can and should be adopted by <br />such other agency (hereinafter referred to as “finding (2)”). <br />(c) Specific economic, legal, social, technological or other considerations, <br />including provision of employment opportunities for highly trained workers, <br />make infeasible the mitigation measures or project alternatives identified in <br />the Final EIR (hereinafter referred to as “finding (3)”). <br /> <br />The required findings shall be supported by substantial evidence in the record. (State CEQA <br />Guidelines, § 15091). <br />The Final EIR incorporates the Draft Program EIR. References within to the “Program EIR” are to the <br />collective documentation contained in the Draft Program EIR and Final Program EIR. All acronyms <br />used within this document shall have the same meaning as defined in the Draft Program EIR. <br />1.2 - Statement of Findings <br />A Program Environmental Impact Report (EIR) pursuant to CEQA Guidelines has been prepared by <br />City of Pleasanton. The Program EIR for the City of Pleasanton 2023-2031 (6th Cycle) Housing <br />Element Update (Housing Element Update) identifies significant effects on the environment, which <br />may occur as a result of the implementation of the Housing Element Update. Section 1.5 sets forth <br />potential environmental effects of the Housing Element Update which are not significant or less than <br />significant. Section 1.6 sets forth those potential environmental effects of the Housing Element <br />Update that are not significant because they can feasibly be mitigated below a level of significance. <br />Section 1.7 discloses the environmental impacts that remain significant and unavoidable even with
