DISCUSSION <br /> Despite the District entering into the MOU in which it commits to diligently work to <br /> complete the construction of the Garms Staging Area by December 2020, the City is <br /> unaware of any District efforts toward that commitment. The District has not <br /> communicated any reason(s) for delaying or abandoning its stated intention to construct <br /> the staging area by December 2020. <br /> The letter to the EBRPD Board of Directors from the City Council is intended to elevate <br /> the inquiry and reiterate the importance of the District following through on the stated <br /> commitment to construct the Garms Staging Area in exchange for the City allowing <br /> development of an access point to the Castleridge property despite the parking and <br /> congestion problems it would, and has, caused for the Alviso Adobe Park. <br /> The MOU includes language that allows the City to revoke the District's right to use the <br /> Castleridge Trailhead across the Alviso Adobe Park; however, the Castleridge Trailhead <br /> is very popular, so it is recommended that efforts be made toward encouraging the <br /> District to construct the primary access from the Garms Staging Area as it committed to. <br /> It is also important to note that an access easement from Old Foothill Road across the <br /> Alviso Adobe Park is dedicated on the park's property title to the benefit of the three <br /> properties to the west of the park. Two of the properties are residential properties, and <br /> the third is the 231-acre EBRPD Castleridge property. The access easement has been <br /> developed by the two residential property owners to serve as their shared driveway, <br /> without consideration for the previously privately owned and undeveloped Castleridge <br /> property. Regardless, the Castleridge property maintains rights to the access easement <br /> without restriction. In 2014, when the District acquired the Castleridge property, City <br /> staff met with District staff who stated the District's intention to use the existing <br /> easement to allow public access to the Castleridge property and Pleasanton Ridge. <br /> District staff also met with the two property owners with which they share rights to the <br /> access easement; the District's stated intention was not received well by the two other <br /> property owners.
