11.38.010 <br />(Pleasanton Supp. No. 28, 7-22) 314 <br />Chapter 11.38 <br /> <br />RESIDENTIAL PERMIT PARKING ZONE <br /> <br />Sections: <br />11.38.010 Definitions. <br />11.38.020 Issuance of permits. <br />11.38.030 Duration and limit on number of <br />permits to be issued. <br />11.38.040 Guest permits. <br />11.38.050 Display of permits. <br />11.38.060 Fees for issuance—Duration of <br />permits. <br />11.38.070 Termination of permits. <br />11.38.080 Posting of residential permit <br />parking zone. <br />11.38.090 Violations. <br />11.38.100 Exemptions. <br />11.38.120 Penalty. <br /> <br />11.38.010 Definitions. <br /> For the purpose of this chapter the following <br />words and phrases shall have the meanings respectively <br />ascribed to them: <br /> “Director” means the director of finance. <br /> “Owner” means a person who has an ownership <br />interest in a parcel of real property within a residential <br />permit parking zone designated pursuant to this chapter. <br /> “Resident” means a person who lives in a residen- <br />tial permit parking zone as his or her permanent place of <br />residence, either as a tenant or owner. <br /> “Residential parking permit” means a permit is- <br />sued pursuant to this chapter. <br /> “Residential permit parking zone” means a resi- <br />dential zone designated as provided in this chapter <br />wherein vehicles displaying a valid permit issued pursu- <br />ant to this chapter shall be exempt from the parking time <br />restrictions established for the permit parking area. <br /> “Vehicle” means an automobile, truck, trailer, <br />house car, motorcycle or other motor driven device for <br />transportation, not in excess of 6,000 pounds gross <br />weight. (Ord. 1931 § 1, 2006; Ord. 1376 § 1, 1988) <br /> <br />11.38.020 Issuance of permits. <br /> Residential parking permits shall be issued by the <br />director of finance. Parking permits may be issued to an <br />owner or resident of a property within a residential park- <br />ing permit zone or to a guest of such an owner or resi- <br />dent duly authorized by the owner or resident to apply <br />for a residential parking permit; provided, that a residen- <br />tial parking permit shall only be issued to an owner or <br />resident, who has a motor vehicle currently registered in <br />his or her name, or who has lawful possession of a mo- <br />tor vehicle for his or her exclusive use and/or which is <br />under his or her control and to individuals providing in <br />home medical care to a resident of a zone; provided, that <br />the in home provider shows proof, in the form of a con- <br />tract or other agreement, of the service being provided. <br />Not more than one residential parking permit shall be <br />issued for any motor vehicle. The city manager may <br />establish rules and regulations necessary or appropriate <br />to carry out the purpose of this chapter. The city man- <br />ager shall require each applicant for a residential parking <br />permit to establish proof of residency and vehicle own- <br />ership, possession or control in compliance with this <br />chapter. (Ord. 1376 § 1, 1988) <br /> <br />11.38.030 Duration and limit on number of <br />permits to be issued. <br /> There shall be no limit to the number of annual <br />permits issued to any residential address within a resi- <br />dential permit parking area; provided, that the resident <br />owns or has control over each of the vehicles for which <br />an annual permit is issued. A separate application shall <br />be filed for each motor vehicle. Each residential parking <br />permit issued by the director shall be valid for a maxi- <br />mum of one year unless otherwise stated on the permit. <br />The city manager shall cause to be prepared and issue <br />effective on or about September 1st of each year, a dis- <br />tinctively colored sticker for issuance to permittees of <br />residential parking permits, which sticker shall be af- <br />fixed to the motor vehicle for which a permit is issued at <br />the location specified in Section 11.38.050 of this chap- <br />ter. (Ord. 1376 § 1, 1988) <br /> <br />11.38.040 Guest permits. <br /> Not more than two guest permits shall be issued <br />for any dwelling unit. Guest permits shall be issued to <br />residents in a residential parking permit zone and may <br />be issued at the same time as the annual permit. Guest <br />permits shall not be used for regular vehicle usage nor to <br />bypass the need to buy an annual permit. Residents who <br />abuse guest pass privileges shall have their annual per- <br />mit privileges revoked for up to one year. (Ord. 1376 § <br />1, 1988) <br /> <br />11.38.050 Display of permits. <br /> Residential parking permits shall be affixed to a <br />motor vehicle at the left rear bumper. Guest permits <br />shall be placed inside the vehicle, visible through the <br />rear window on the driver’s side or attached to the rear- <br />view mirror. (Ord. 1376 § 1, 1988)
