BACKGROUND <br /> In 2014, DSRSD developed and implemented a residential recycled water fill station <br /> program at the DSRSD Regional Wastewater Treatment Plant (WWTP) for residential <br /> customers. In 2016, the DSRSD Board reviewed operational and financial options for <br /> the fill station. A construction project was planned at that site to start in 2017 and <br /> continue through 2018, so the DSRSD Board directed closure of the fill station to avoid <br /> conflicts with the project construction. <br /> In November 2021, the DSRSD Board authorized staff to explore the use of its <br /> undeveloped property on Gleason Drive in Dublin. Following City Council's action on <br /> April 19, 2022, to rescind the previously approved agreement with the City of <br /> Pleasanton, City of Livermore, and DSRSD (Agencies) for the Temporary Joint <br /> Residential Recycled Water Fill Station and to continue work with the Agencies on a <br /> new, less expensive option, staff discussed finding a location that was convenient for <br /> public access and had a lower development cost than the Gleason Drive site. The site <br /> also needed to be near a source of recycled water and on public property. The Parkside <br /> Drive site met these criteria and so was identified as a potential site. <br /> These efforts are outlined in the attached June 21 agenda report, leading to the City <br /> Council's approval of the agreement for a recycled water fill station at 5997 Parkside <br /> Drive (Attachment 1). Following the Council's action, City staff had been reviewing a <br /> Temporary Use Permit application for the Recycled Water Fill Station. Noticing <br /> postcards were sent to neighbors within 1,000 feet, which is the City's standard noticing <br /> radius for projects of this type. The notices elicited opposition from residents in the <br /> Parkside neighborhood. <br /> DISCUSSION <br /> At the July 19 Council meeting, the Council requested reconsideration of the regional <br /> agreement for the project at the 5997 Parkside Drive location. At this time, staff has <br /> stopped work on this project and notified the City of Livermore, Zone 7 Water Agency, <br /> and Dublin San Ramon Services District of the City's reconsideration of this project. <br /> Agreement <br /> The agreement was developed such that each agency would be responsible for a <br /> balanced set of responsibilities for the project and would fund an equal share of the <br /> development, operation, and maintenance costs. The development costs are estimated <br /> at $450,000 and the annual operating costs are estimated at $300,000. As noted in the <br /> June 21 report, Pleasanton's portion of the construction and the first year of operation of <br /> the fill station project is $165,000. The term of the agreement is through December 31, <br /> 2023; however, among the agreement's general provisions is a process for termination <br /> of the agreement which indicates: <br /> A. Termination <br /> The Parties may, at any time, terminate the Agreement immediately or <br /> suspend operations, subject to any actions determined necessary to safely <br /> terminate or suspend operations and apportion costs as described in <br /> Page 2 of 3 <br />
