<br /> THIS GRANT OF EASEMENT is made and entered into this�day of A41L 2021 by and
<br /> i between Leisure Sports, Inc., a Cslfomte Corporation,as to an undivided 2/3 interest North Point Trust
<br /> Company, LLC.,a South Dakota limited lability company,in its capacity as Administrative Trustee of The
<br /> LSI-S Trust created under The LSI-S Tent Agreement dated June 29,2016,as to an undivided 116 interest;
<br /> and North Point Trust Company, LL.C., a South Dakota limited liability company, In its capacity as
<br /> Administrative Trustee of The LSI-D Trust created under The LSI-D Trust Agreement dated June 29,2018,
<br /> as to an undivided 1/8 interest(colectively,'Grantor"),and the City of Pleasanton("Grantee").
<br /> For valuable consideration, receipt of which is acknowledged. Grantor grants to Grantee a permanent
<br /> ' easernent and right of way for roadway,sidewalk and landscaping purposes,including the right to construct,
<br /> repine, kwp@M maintain, repair.operate or remove a roadway.supporting columns,wale and footings,
<br /> sidewalks, pathways, landscaping including any and all appurtenances thereto (collectively, the
<br /> "Improvernents'),am,under,upon and across the following described real property sk sted in the City of
<br /> i Pleasanton,County of Alameda.Side of Cahfomis,described se follows:

<br /> Grantor ro vee the right to use the easement parte for al purposes not Inconsistent with the saeemm
<br /> However,such use by Grantor shall not Include the construction of permanent structures,Including,but not
<br /> limited to,buildings,retaining waft,decks,patios,or other concrete structures within the o nernent.
<br /> All work sham be performed by contractors duly lensed by the Sate of California, in a good and
<br /> workmanil s manner. Grardea agrees upon completion of ib construction of the lnp moments hereunder
<br /> to restore as now as possible the surface of the ground to the condition in which 4 was pylar to the
<br /> commencement of said construction.
<br /> Grantee shall maintain,repair and replace,at Grantee's sola cost and expense,the Improvement. If during
<br /> the maintenance, repair or replacement of the Improvements elther Grantee, or any of its contractors,
<br /> agents,empbyess or representatives,should cause damage to the easement was,Grahae shall promptly
<br /> repair such damage and restore, to the extent reasonably practicable, the essoment ares to Its original
<br /> condition prior to any work being performed (except for the Improvements thereon); except to the extent
<br /> nnmou3.2
