Tie Votes (Section 14.2) <br /> The current Rules and Procedures provide that in tie vote situations where an official is <br /> absent, the matter is automatically continued to a future meeting where all officials are <br /> present. (Section VII.F, page 16) The draft Rules of Procedure would instead have tie <br /> vote matters only continued at the option of the City Council. <br /> Votes — Abstentions and Silence (Section 14.3) <br /> The draft Rules of Procedure would adopt Rosenberg's "those present and voting" rule <br /> whereby officials present are counted for quorum purposes; but when an official <br /> abstains (without a financial or due process conflict of interest) or remains silent when <br /> the vote is called, the office is marked as not having voted. The current Rules and <br /> Procedures provide that silence is an affirmative vote, and abstention is a vote with the <br /> majority. <br /> Advisory Bodies (Section 15) <br /> Language added to address: situations when City employees apply for appointment <br /> (Section 15.1 .6); and criteria to consider reappointments (contributions during prior <br /> term, accomplishments while serving, etc.) (Section 15.1.7). <br /> The process for removal of a commissioner or committee member by City Council <br /> majority vote (Section X.B, page 22) has been removed, as the basis for membership in <br /> each commission or committee is already set forth in the Municipal Code or authorizing <br /> resolution. <br /> Ordinance Introduction/Adoption (Section 16.3) <br /> New language codifies the current practice that ordinances are introduced (first reading) <br /> by just having the title read; and allows adoption (second reading) on consent calendar <br /> even if introduction was not unanimous. This is a clarification from the current process <br /> (Section VIII.B). <br /> Majority Vote by Three Council Members Required (Section 16.4) <br /> Added new section to set out requirement of California law. <br /> City Council Expectations (Section 17) <br /> As stated, the draft Rules of Procedure set out both requirements of California law and <br /> the Pleasanton Municipal Code, as well as expected public service standards of <br /> conduct. Language (modeled after the City of Sunnyvale) is added to describe a <br /> process for officials to initiate when another official is not properly following these <br /> procedures. (Section 17.1) <br /> Language is also added limiting use of electronic devices during meetings, to align with <br /> the Brown Act, due process, and common courtesy.
