DISCUSSION <br /> Following the order of the draft Rules of Procedure, subjects where the draft Rules of <br /> Procedure propose a change in approach from the 1995 Rules are described below. <br /> Rules of Parliamentary Procedure (Sections 3 and 7.9) <br /> The draft Rules of Procedure would have the City utilize Rosenberg's Rules of Order for <br /> the processes to make motions, debate, and vote. The use of Rosenberg's Rules is <br /> endorsed by the League of California Cities as more understandable, concise (just six <br /> pages), and applicable to council meetings with five or more officials. The current Rules <br /> and Procedures reference Robert's Rules of Order, the current Twelfth Edition (2020) <br /> contains 633 pages of text and is more suited to deliberative assemblies and mass <br /> meetings. Rosenberg's Rules would also apply to points of order, privilege, and <br /> personal privilege. <br /> Appointment of Vice-Mayor (Section 6.1) <br /> Codifies that the Mayor appoints the Vice-Mayor, with City Council approval. The <br /> current Rules and Procedures are silent on this matter. <br /> Intergovernmental Agencies (Section 6.2) <br /> The draft Rules of Procedure mirror the current rules in that the Mayor makes <br /> appointments of Councilmembers to outside agencies, with City Council approval. The <br /> current Rules and Procedures also have text regarding: <br /> - Process to remove a representative (Section IX.3, pg. 20); <br /> - Representative is to articulate the City's position and not the individual's <br /> position (Section IX.4, pg. 20); and <br /> - Officials may speak before other public bodies as private citizens (Section <br /> IX.7, pg. 20). <br /> These points are not included in the draft Rules of Procedure, but can be incorporated <br /> here, or added to a separate Code of Conduct as an item at a future meeting. <br /> Seats on the Dais (Section 6.3) <br /> New section clarifies how seats on the dais are assigned. <br /> Continuance of Agenda Items (Section 7.7) <br /> Adds a requirement that when an individual official continues an item, the official must <br /> "state the reason for such continuance." <br /> Consideration of items to be heard after 11:00 p.m. (Section 7.8) <br /> Would have the Council decide prior to or by 10:30 p.m. which pending items to still <br /> hear that evening. The current Rules and Procedures have Council consider this at <br /> 11:00 p.m. <br /> Recording of meetings (Sections 7.10.1 and 7.10.3) <br /> Update to reflect actual practice and current technology. <br /> Page 3 of 6 <br />
