Other Related Services and Standards <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 77 June 7, 2022 <br />6.1.3 Billing Inserts 2733 <br />City may direct Contractor to insert up to ten (10) mailers per year into Billings relating to service with the 2734 <br />Billings including inserts prepared by StopWaste.Org (also known as the Alameda County Waste 2735 <br />Management Authority and Alameda County Source Reduction and Recycling Board). The mailers must 2736 <br />fit in standard envelopes. Contractor also agrees to insert with the Billings, mailers describing activities 2737 <br />of the City government. City will provide not less than thirty (30) calendar days’ notice to Contractor prior 2738 <br />to the mailing date of any proposed mailing to permit Contractor to make appropriate arrangements for 2739 <br />inclusion of the City's materials. City will provide Contractor the mailers at least fifteen (15) calendar days 2740 <br />prior to the mailing date. The cost of printing such inserts and any additional postage shall either be paid 2741 <br />for by the City or included in the costs upon which Rates are based. 2742 <br />6.2 Records 2743 <br />6.2.1 General 2744 <br />Contractor shall maintain such accounting, statistical, and other records related to its performance under 2745 <br />this Agreement as shall be necessary to develop the financial statements and other reports required by 2746 <br />this Agreement. Also, Contractor agrees to conduct data collection, information and record keeping, and 2747 <br />reporting activities needed to comply with and to meet the reporting and Solid Waste program 2748 <br />management needs of Contractor and AB 939, SB 1383, and other federal, State, and local laws and 2749 <br />regulations and the requirements of this Agreement. To the extent such requirements are set out in this 2750 <br />and other Articles of this Agreement, they shall not be considered limiting or necessarily complete. In 2751 <br />particular, this Article is intended to only highlight the general nature of records and reports and their 2752 <br />minimum content and is not meant to comprehensively define what the records and reports are to be 2753 <br />and their content. Further, with the written direction from the City, the records and reports to be 2754 <br />maintained and provided by Contractor in accordance with this and other Articles of the Agreement shall 2755 <br />be adjusted in number, format, or frequency. Records and reporting may be revised to reflect current 2756 <br />record keeping and reporting requirements. 2757 <br />Contractor shall maintain records required to conduct its operations, to support requests it may make to 2758 <br />City, and to respond to requests from City. Adequate record security shall be maintained to preserve 2759 <br />records from events that can be reasonably anticipated such as a fire, theft, and earthquake. 2760 <br />Electronically-maintained data/records shall be protected and a second copy of data/records shall be 2761 <br />saved to a protected source such as an external hard-drive. 2762 <br />Contractor agrees to provide or make available records of any and all companies conducting operations 2763 <br />addressed in the Agreement to City and its agents and/or representatives during normal business hours. 2764 <br />The Parties acknowledge that as of the Effective Date of this Agreement, the Contractor’s accounting and 2765 <br />management information systems may not have the capability of meeting the requirements of this 2766 <br />Agreement. As of the Effective Date, the Contractor has identified any necessary revisions to its existing 2767 <br />systems or selected replacement systems, and has entered into agreements for such revisions or 2768 <br />implementation of such systems, including training of Contractor’s staff in order to meet the requirements 2769 <br />of this Agreement. Plans for the modification or implementation of such system have been provided by 2770 <br />the Contractor to the City. Contractor’s failure to successfully implement systems which enable reporting 2771 <br />and data management as required by this Agreement within one (1) year from the Effective Date shall be 2772
