Collection Services <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 61 June 7, 2022 <br />5.16.3 Purchase of New Containers 2172 <br />Contractor shall be responsible for replacing the existing Containers when Contractor determines the 2173 <br />Container is no longer suitable for service; or when the City or Customer requests replacement of 2174 <br />Customer’s Container that does not properly function, leaks, is damaged, or is otherwise not fit for service. 2175 <br />Contractor shall be responsible for acquiring the replacement Containers as well as maintaining an 2176 <br />inventory of Containers at a level that allows for the Contractor to provide Customers with new, 2177 <br />replacement and different size Containers within seven (7) calendar days of request. 2178 <br />Contractor shall purchase Containers with a useful life of ten (10) years or more and shall depreciate the 2179 <br />Containers over a ten-year (10-year) period. All new Containers shall comply with the standards 2180 <br />presented in Section 5.16.5. 2181 <br />5.16.4 City Ownership of Containers at end of Term 2182 <br />Upon expiration or early termination of Agreement, all Carts, Bins, Drop Boxes, and Compactors (for 2183 <br />permanent Customers) purchased and put into service at Customers’ Premises during the Term of the 2184 <br />Agreement shall become property of the City at no cost to the City if such Containers are fully depreciated. 2185 <br />All Carts, Bins, Drop Boxes, and Compactors (for permanent Customers) purchased and put into service at 2186 <br />Customers’ Premises during the Term of the Agreement that have not been fully depreciated shall be 2187 <br />available to the City, at the City’s option, at a cost reflecting the net book value. 2188 <br />At its sole discretion, the City may elect not to exercise its rights with regards to this Section and, in such 2189 <br />case; the Containers shall remain the property of the Contractor upon the expiration date of this 2190 <br />Agreement or date of its earlier termination of this Agreement. In such case, Contractor shall be 2191 <br />responsible for outstanding depreciation and for removing all Containers in service from Premises within 2192 <br />ten (10) Business Days of the expiration date or early termination date of this Agreement. 2193 <br />5.16.5 New Container Standards 2194 <br />Contractor shall provide Containers for storage and Collection of Solid Waste, Recyclable Materials, and 2195 <br />Organic Materials that are designed and constructed to be watertight and prevent the leakage of liquids. 2196 <br />Contractor shall purchase Carts that contain a minimum of 20% post-consumer recycled plastic content 2197 <br />and kitchen pails that contain a minimum of 20% post-consumer recycled plastic content. All Carts and 2198 <br />kitchen pails shall be 100% recyclable. 2199 <br />All new Carts shall be manufactured by injection or rotational molding methods and shall meet the Cart 2200 <br />design, color, and performance requirements provided in Exhibit D. Contractor shall obtain the City’s 2201 <br />written approval of Cart specifications before acquisition. Carts provided to Customers shall have a useful 2202 <br />life of ten (10) or more years as evidenced by a manufacturer’s warranty or other documentation 2203 <br />acceptable to the City. 2204 <br />All Containers with a capacity of one (1) cubic yard or more shall meet applicable federal regulations for 2205 <br />Bin safety and be covered with attached lids. All Bins, Drop Boxes, and Compactors shall be painted the 2206 <br />Contractor's standard color and shall prominently display the name and telephone number of the 2207 <br />Contractor. 2208
