The drop-off area shall be open 8:00AM to 4:00PM seven (7) days per week (except legal 1399 <br />Holidays). 1400 <br />5.11 Hazardous Waste 1401 <br />If Contractor determines that material placed in any Container for Collection is Hazardous Waste, 1402 <br />Designated Waste, or other material that may not legally be Disposed of or handled at the Approved 1403 <br />Facilities or presents a hazard to Contractor's employees, the Contractor shall have the right to refuse to 1404 <br />accept such material. However, Contractor shall accept: Used Motor Oil and Filters placed by Generator 1405 <br />for Collection as a Recyclable Material; E-Waste accepted on an on-call basis or through Single-Family on-1406 <br />call clean-up service. The Generator will be contacted by the Contractor and requested to arrange proper 1407 <br />Disposal. If the Generator cannot be reached immediately, the Contractor shall, prior to leaving the 1408 <br />Premises, leave a tag at least two (2) inches by six (6) inches which lists the phone number for the Alameda 1409 <br />County Household Hazardous Waste program, indicating the reason for refusing to Collect the material. 1410 <br />If the material could possibly result in imminent danger to people or property, the Contractor shall notify 1411 <br />the Livermore/Pleasanton Fire Department using the 911 emergency number as soon as possible. 1412 <br />The Contractor shall notify the City of any Hazardous Waste left at any Premises for fourteen (14) or more 1413 <br />calendar days. 1414 <br />If Hazardous Waste is delivered to the Approved Facilities by Contractor before its presence is detected 1415 <br />and the Generator cannot be identified or fails to remove the material after being requested to do so, the 1416 <br />Contractor shall arrange for its proper Disposal. The Contractor shall make a good faith effort to recover 1417 <br />the cost of Disposal from the Generator, and the cost of this effort, as well as the cost of Disposal shall be 1418 <br />chargeable to the Generator. The Contractor shall be entitled to include the costs incurred under this 1419 <br />Section as an operating expense for purposes of compensation under Article 8 and shall include all sums 1420 <br />recovered by it from Generators as "Other Income.” 1421 <br />5.12 Transportation of Collected Materials 1422 <br />Contractor shall Transport all Solid Waste, Recyclable Materials, Organic Materials, C&D, and Bulky Items 1423 <br />Collected under this Agreement to the Disposal, Processing, or Organic Materials Processing Sites 1424 <br />approved by the City. Contractor shall maintain accurate records of the quantities of Solid Waste, 1425 <br />Recyclable Materials, Organic Materials, C&D, and Bulky Items Transported to each Approved Facility and 1426 <br />will cooperate with City in any audits or investigations of such quantities. 1427 <br />Prior to delivering Collected materials for Processing and/or Disposal, Contractor shall Transport Solid 1428 <br />Waste, Recyclable Materials, Organic Materials, C&D, and Bulky Items Collected in the City to the 1429 <br />Approved Transfer Site where the materials will be unloaded from Collection vehicles and loaded into 1430 <br />large-capacity vehicles and Transported to the appropriate Approved Processing Site and/or Approved 1431 <br />Disposal Site. If the Contractor is unable to use said facility, then the Contractor shall be responsible for 1432 <br />making other Transportation arrangements, in accordance with Section 5.21. In such event, Contractor 1433 <br />shall not be compensated for any additional costs. If the Contractor plans to change its Transfer method, 1434 <br />Contractor shall obtain written approval from the City prior to making the change. 1435
