<br />1.77 "Organic Materials" or “Organics” means any combination of Food Scraps, Yard Trimmings, 386
<br />Compostable Plastics (if applicable), and Clean Wood. Organic Materials is a subset of Organic Waste. 387
<br />1.78 “Organic Materials Processing Site” means any plant, facility, or site used for the Processing and 388
<br />Composting of Organic Materials for the purpose of making Compost, Mulch, or other marketable 389
<br />material. 390
<br />1.79 “Organic Waste” means wastes containing material originated from living organisms and their 391
<br />metabolic waste products including, but not limited to, food, Yard Trimmings, organic textiles and 392
<br />carpets, lumber, wood, paper products, printing and writing paper, manure, biosolids, digestate, and 393
<br />sludges, or as otherwise defined in 14 CCR Section 18982(a)(46). Biosolids and digestate are as defined 394
<br />in 14 CCR Section 18982(a)(4) and 14 CCR Section 18982(a)(16.5), respectively. 395
<br />1.80 "Owner" means the Person holding legal title to the land or building. 396
<br />1.81 "Party or Parties" means the City and Contractor, individually or together. 397
<br />1.82 "Person" means an individual, firm, limited liability company, association, partnership, political 398
<br />subdivision, government agency, municipality, industry, public or private corporation, or any other 399
<br />entity whatsoever. 400
<br />1.83 "Premises" means any land or building in the City where Solid Waste, Recyclable Materials, or 401
<br />Organic Materials are generated or accumulated. 402
<br />1.84 "Processing” or “Process” (or any variation thereof) means to prepare, treat, or convert through 403
<br />some special method, including, but not limited to, baling, crushing, shredding, chipping, grinding, 404
<br />extracting, mechanical or hand classification, and any other method of handling Recyclable Materials, 405
<br />Organic Materials, and C&D by the Contractor at the Approved Facility(ies). 406
<br />1.85 "Processing Site" means any plant or site used for the purpose of sorting, cleansing, treating, or 407
<br />reconstituting Salvageable Material for the purpose of making such material available for reuse. 408
<br />Activities that may be undertaken at a Processing Facility include, but are not limited to, Processing 409
<br />Organic Materials and Recyclable Materials. 410
<br />1.86 “Prohibited Container Contaminants” means the following: (i) Discarded Materials placed in the 411
<br />Recyclable Materials Container that are not identified as acceptable Recyclable Materials for the City’s 412
<br />Collection program; (ii) Discarded Materials placed in the Organic Materials Container that are not 413
<br />identified as acceptable Organic Materials for the City’s Collection program; (iii) Discarded Materials 414
<br />placed in the Solid Waste Container that are acceptable Recyclable Materials and/or Organic Materials 415
<br />to be placed in the City’s Recyclable Materials or Organic Materials Containers or otherwise managed 416
<br />under the City’s Collection program; and, (iv) Excluded Waste placed in any Container. 417
<br />1.87 "Putrescible Waste" means Solid Wastes originated from living organisms and their metabolic 418
<br />waste products, which contains naturally produced organic compounds and which are biologically 419
