RESOLUTION NO. 22-1290 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING THE CITY'S ADMINISTRATIVE POLICY: PURCHASING PROCEDURES <br /> AND MANUAL TO COMPLY WITH STATE LAW SB 1383 <br /> WHEREAS, the Administrative Policy: Purchasing Procedures and Manual guides staff <br /> regarding contracting for goods, equipment and services in compliance with federal, state and <br /> local laws and policies; and <br /> WHEREAS, SB 1383 was signed into law in 2016 and addresses reducing short-lived <br /> climate pollutants and is a significant waste reduction mandate that requires the State to reduce <br /> organic waste (food waste, green waste, paper products, etc.) disposal by 75 percent by 2025 <br /> and to increase edible food recovery by 20 percent by 2025; and <br /> WHEREAS, SB 1383 requires each jurisdiction to procure annually certain levels of <br /> materials derived from organic waste diverted from the landfill such as: compost, mulch, <br /> renewable gas used for transportation fuels, electricity, heating applications, pipeline injection, <br /> or electricity from biomass conversion produced from organic waste; and <br /> WHEREAS, SB 1383 requires each jurisdiction to procure paper products consistent <br /> with the requirements of the Public Contract Code §22150 through §22154; and <br /> WHEREAS, SB 1383 requires jurisdictions to keep an implementation record and to <br /> develop a plan that demonstrates the jurisdiction's approach to implementing SB 1383; and <br /> WHEREAS, the City Council adopted the SB 1383 Action Plan on June 15, 2021 which <br /> identifies amending the City Administrative Policy: Purchasing Procedures and Manual as an <br /> action item to comply with SB 1383. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1: That the amendments to the Purchasing Procedures and Manual is <br /> exempt from environmental review under the California Environmental Quality Act per Title 14 <br /> California Code of Regulations §15061(b)(3). <br /> SECTION 2: Adopts amendments to the Purchasing Procedures and Manual as set <br /> forth in the attached Exhibit A. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on May 3, 2022. <br />
