BACKGROUND <br /> Brian Dolan, who was appointed as the City's interim city manager beginning December <br /> 1, 2021, is set to retire from the City of Pleasanton on June 4, 2022, following Gerry <br /> Beaudin's start as the permanent city manager on May 23, 2022. <br /> There are initiatives currently underway that require institutional knowledge including <br /> key development projects, organizational programs and financial processes, particularly <br /> continuing to direct preparation and adoption of the City's FY2022/23 Mid-Term <br /> Operating and CIP Budgets prior to the end of the fiscal year. As such, there is a need <br /> to retain Brian Dolan's services to work in these strategic areas on a temporary basis <br /> and no later than June 30, 2022. <br /> DISCUSSION <br /> Retired annuitants are retirees who return to work with a California Public Employees' <br /> Retirement System (CaIPERS) employer in a designated retired annuitant position. The <br /> city manager is responsible for the overall operational management of the City <br /> organization as well implementing the City Council's policy direction and work plan <br /> priorities, requiring expertise in finance, staff manager and administration as well as a <br /> deep understanding of the organization and the community. Notably, as the interim <br /> manager is currently directing the development and adoption of the mid-term budgets, <br /> the City would benefit from retaining this employee to return to work as a designated <br /> retired annuitant to allow for a seamless transition that provides the necessary expertise <br /> and continuity of services during the transition to the permanent city manager. <br /> Government Code (GC) Sections 7522.56 and 21224 permit extra help retired <br /> annuitants under CaIPERS to be employed upon appointment by a public agency to fill <br /> a critically needed position on an interim basis before 180 days have passed. <br /> Basic requirements include: <br /> • The salary must be no more than an hourly pay rate that falls within the regular <br /> salary schedule for that position. (A retired annuitant is not entitled to any <br /> benefits, vacation, or holidays). <br /> • A maximum of 960 hours can be worked within a fiscal year (July 1 to June 30) <br /> including non-paid / volunteer hours. <br /> • Annuitant must wait 180 days after their retirement date before returning to work. <br /> Per GC 21224, "a retired person may serve without reinstatement from retirement or <br /> loss or interruption of benefits upon appointment by the appointing power of a public <br /> agency employer to prevent stoppage of public business or because the retired person <br /> has specialized skills needed in performing work of limited duration." A resolution is <br /> required to authorize this specific position for extra help retired annuitant status and for <br /> the waiver of the 180-day waiting period. <br /> Page 2 of 3 <br />
