BACKGROUND <br />On February 15, 1966, a freeway maintenance agreement was executed between the <br />County of Alameda and the State for the development of the portion of the state <br />highway Interstate Route 580 (1-580) within the limits of the County of Alameda. In <br />1969, the City entered into a freeway maintenance agreement taking over the <br />maintenance responsibility from the County which covered Hopyard Road. In August <br />1986, the City entered into an agreement with Caltrans for the construction of a <br />northbound overcrossing structure at the Hopyard Road, Dougherty Road, and 1-580 <br />interchange. <br />On June 6, 1989, the City entered into an updated freeway maintenance agreement <br />with Caltrans for 1-580 within the city limits. <br />On September 6, 1994, the City entered into a cooperative agreement with Caltrans for <br />the installation of highway plantings and an automatic irrigation system at the Hopyard <br />Road and 1-580 interchange. <br />On February 23, 2010, the City entered into an agreement with Caltrans for landscape <br />maintenance within the state highway right of way on 1-580 for various locations, <br />including Hopyard Road. <br />DISCUSSION <br />The City is working with Caltrans to obtain an encroachment permit for the Hopyard <br />Road and Owens Drive Intersection Improvements Project, CIP No. 15525. The project <br />proposes to construct a southbound right -turn lane along Hopyard Road at the Owens <br />Drive intersection and to add a southbound bike lane to close the existing bike lane gap <br />from the eastbound 1-580 off -ramp intersection to the south of Owens Drive. The project <br />will include a new sound wall placed alongside the existing building'in the northwest <br />quadrant of the intersection as the roadway is within 13 feet of the closest building. The <br />proposed improvements within the State's right of way require the City to obtain an <br />encroachment permit from Caltrans. <br />As part of Caltrans' review and before issuance of an encroachment permit, Caltrans <br />has required an update to the Freeway Maintenance Agreement for Hopyard Road and <br />1-580 bridge overcrossing. This includes updated mapping of the areas of ownership <br />and documentation of responsibility. <br />The attached project -specific maintenance agreement consolidates the previous <br />agreements into one agreement and clarifies the responsibilities of both the State and <br />the City concerning the roadway, bike path, bridge overcrossing, landscaped area, and <br />sound wall maintenance for the Hopyard Road and 1-580 bridge overcrossing. <br />Page 2 of 3 <br />
