b. The Consultant shall provide contract personnel and Consultant resources available for <br /> emergency response at the same hourly rates and conditions specified in this Agreement. <br /> If City has a need for the consultant to work overtime in an emergency event,the consultant <br /> shall be compensated for overtime per state law. <br /> c. The CONSULTANT acknowledges that emergency response work may require variations <br /> in work hours and assignments. <br /> Miscellaneous Duties Compensation: <br /> Consultant shall perform other related activities and duties as requested by the City. Fees for such <br /> services shall be paid on a time and material basis at the hourly rate as assigned for plan review,counter <br /> and/or inspection services,as required. <br /> Compensation Terms: <br /> An hourly fee increase will be provided at the start of year 3 (7/l/2024)based on the latest published <br /> Engineering News Record(ENR)Construction Cost Index(CCI)for the San Francisco Bay Area <br /> (rounded up to nearest dollar). Consultant must provide the City an updated rate sheet reflecting the <br /> new rates by May 2024. <br />
