In response to Mayor Brown, Councilmember Testa reported she is in the same situation with the <br /> FPPC and also requested a continuance. <br /> Mayor Brown explained there are 29 sites in the City to be submitted for an Environmental Impact <br /> Report (EIR), and many could be within 500 feet of Councilmembers' homes, potentially requiring two <br /> out of five members of the dais to recuse themselves. <br /> Councilmember Narum moved to continue Item 12. Councilmember Arkin seconded the motion. <br /> MOTION: It was m/s by Narum/Arkin to continue Item 12 to a future council meeting. Motion <br /> passed by the following vote. <br /> Ayes: Councilmembers Arkin, Balch, Narum, Testa, Mayor Brown <br /> Noes: None <br /> Absent: None <br /> City Attorney Dan Sodergren reported these advice letters typically return within 21 days. He theorized <br /> the longer response time is due to the complexity of the issue but expects to have responses by the <br /> next City Council meeting. <br /> Mayor Brown advised those wishing to speak tonight about the Housing Element can comment during <br /> Item 9. <br /> CONSENT CALENDAR <br /> Councilmember Arkin moved to approve the Consent Calendar. Councilmember Narum seconded the <br /> motion. <br /> Mayor Brown opened the public hearing. There being no comments, the public hearing was closed. <br /> City Attorney <br /> 1. Public Hearing — Adopted and waived full reading of Resolution No. 22-1266 of declaring <br /> intention to renew the Tri-Valley Tourism Marketing District (MMD) and fixing the time and place <br /> of a public meeting and a public hearing thereon and giving notice thereof: and adopted and <br /> waived full reading of Resolution No. 22-1267 requesting consent of the cities of Livermore, <br /> Dublin, and the Town of Danville. and Contra Costa County to renew the Tri-Valley Tourism <br /> Marketing District (TVTMD) and administer assessments <br /> City Council Minutes Page 2 of 17 January 18, 2022 <br />
