Resolution No. 04-061 <br />Page 2 <br /> <br />Section 9280 of the Elections Code specifies that the City Council may direct the City <br />Clerk to transmit an initiative to the City Attorney to prepare an impartial analysis of the <br />measure; and <br /> <br />WHEREAS, <br /> <br />Section 9282 of the Elections Code specifies that the legislative body, or any member or <br />members of the legislative body authorized by that body, may file a written argument for <br />any city measure; and <br /> <br />WHEREAS, Section 9285 of the Elections Code sets forth the procedures for rebuttal arguments. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS <br />FOLLOWS: <br /> <br />Section 1: <br /> <br />That a City Council-sponsored initiative regarding the requirement that the electorate <br />vote on the Phase II land use plan for the Bemal Property be placed on the November 2, <br />2004 General Election and the Initiative Ordinance is attached to this resolution. The <br />measure shall be designated by letter by the Alameda County Registrar. <br /> <br />Section 2: <br /> <br />The ballot language shall be as follows: <br />Shall the voters be guaranteed the right to approve the land use plan (Phase II) for the <br />Bemal Property? <br /> YES <br /> NO <br /> <br />Section 3: <br /> <br />The City Clerk is directed to transmit the initiatives to the City Attorney to prepare an <br />impartial analysis of the measures. <br /> <br />Section 4: <br /> <br />Arguments for the initiative must be submitted to the City Clerk by 5:00 p.m. on August <br />16, 2004. <br /> <br />Section 5: <br /> <br />The City Council hereby adopts the procedures set forth in Sections 9285 of the Elections <br />Code regarding submission of rebuttal arguments. <br /> <br />Section 6: <br /> <br />The City Council hereby requests the Alameda County Board of Supervisors to order this <br />election be conducted by Alameda County on November 2, 2004, in conjunction with the <br />General Election being held within the County on that date, with the actual costs for said <br />election to be reimbursed by the City to the County. <br /> <br />Section 7: This Resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY <br />ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A MEETING HELD <br />ON AUGUST 3, 2004 BY THE FOLLOWING VOTE: <br /> <br /> <br />
