Resolution No. 04-061 Page 2 Section 9280 of the Elections Code specifies that the City Council may direct the City Clerk to transmit an initiative to the City Attorney to prepare an impartial analysis of the measure; and WHEREAS, Section 9282 of the Elections Code specifies that the legislative body, or any member or members of the legislative body authorized by that body, may file a written argument for any city measure; and WHEREAS, Section 9285 of the Elections Code sets forth the procedures for rebuttal arguments. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: That a City Council-sponsored initiative regarding the requirement that the electorate vote on the Phase II land use plan for the Bemal Property be placed on the November 2, 2004 General Election and the Initiative Ordinance is attached to this resolution. The measure shall be designated by letter by the Alameda County Registrar. Section 2: The ballot language shall be as follows: Shall the voters be guaranteed the right to approve the land use plan (Phase II) for the Bemal Property? YES NO Section 3: The City Clerk is directed to transmit the initiatives to the City Attorney to prepare an impartial analysis of the measures. Section 4: Arguments for the initiative must be submitted to the City Clerk by 5:00 p.m. on August 16, 2004. Section 5: The City Council hereby adopts the procedures set forth in Sections 9285 of the Elections Code regarding submission of rebuttal arguments. Section 6: The City Council hereby requests the Alameda County Board of Supervisors to order this election be conducted by Alameda County on November 2, 2004, in conjunction with the General Election being held within the County on that date, with the actual costs for said election to be reimbursed by the City to the County. Section 7: This Resolution shall become effective immediately upon its passage and adoption.
