CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 04-061 <br /> <br />RESOLUTION AUTHORIZING THE PLACEMENT ON THE NOVEMBER 2, 2004 <br />REGULAR ELECTION OF A CITY COUNCIL SPONSORED INITIATIVE PROPOSING AN <br />AMENDMENT TO THE BERNAL PROPERTY SPECIFIC PLAN CONCERNING THE <br />REQUIREMENT THAT THE ELECTORATE VOTE ON THE PHASE II LAND USE PLAN <br />FOR THE BERNAL PROPERTY, DIRECTING THE CITY ATTORNEY TO PREPARE AN <br />IMPARTIAL ANALYSIS OF THE INITIATIVE, AUTHORIZING ARGUMENTS <br />CONCERNING THE INITIATIVE MEASURE, ALLOWING REBUTTAL ARGUMENTS, AND <br />REQUESTING ALAMEDA COUNTY TO CONDUCT THIS ELECTION IN CONJUNCTION <br />WITH THE NOVEMBER 2, 2004 REGULAR ELECTION. <br /> <br />WHEREAS, on August 21, 2000, the City Council adopted the Bernal Property Specific Plan; and <br /> <br />WHEREAS, that Specific Plan described an area, now owned by the City, designated as Phase II of <br /> the Specific Plan; and <br /> <br />the City Council adopted as part of the Land Use Element of that Specific Plan certain <br />land use policies and guidelines concerning the community facilities to be developed <br />within the Phase II Plan area; and <br /> <br />WHEREAS, <br /> <br />Guideline 1.3 of Land Use Policy 1 (Community Facilities) provides in part that the <br />Phase II land use plan for the City-owned land shall be subject to approval of the <br />electorate before implementation; and <br /> <br />WHEREAS, <br /> <br />development of these facilities will affect the community for years to come and the <br />citizens of Pleasanton have expressed a strong interest that their voice should be heard in <br />determining the land use plan for this property; and <br /> <br />WHEREAS, <br /> <br />it is the Council's intent that Guideline 1.3 of Land Use Policy 1 be reaffu'med and <br />readopw..d by the voters and that this Guideline be changed only by the voters of <br />Pleasanton; and <br /> <br />WHEREAS, <br /> <br />Section 9222 of the Elections Code permits the City Council to submit to the voters, <br />without a petition therefore, a proposition for the repeal, amendment or enactment of an <br />ordinance; and <br /> <br />WHEREAS, the City Council has reviewed and considered the Initiative Ordinance attached to this <br /> Resolution; and <br /> <br /> <br />
