Mayor Brown advised she would like bicycles and cars moved back from the parklets and supported the staffs seven-foot depth recommendation. She noted it also provides a little clearance for safety around vehicles not parked flush to the curb while people are dining on a City street. Councilmember Balch advised some of the current pop-ups egregiously protrude so he understands Mayor Brown's point about diner safety concerns. Mayor Brown reported this item may need to be bifurcated, trifurcated, or even more. Councilmember Testa reported she likes Disneyland and called for a uniform umbrella color due to their high visibility. She advised she would like to see as much solar and battery lighting as possible. In response to Mayor Brown, Ms. Campbell advised votes or feedback on each specific topic being discussed would be good. In response to Mayor Brown, the dais agreed a street lighting CIP should be conducted and, in the meantime, solar and battery-powered lighting should be required. In response to Mayor Brown, City Clerk Jocelyn Kwong advised the City Council does not need to formally vote in this. In response to Mayor Brown, Councilmember Balch supported Councilmember Arkin's suggestion to waive the annual fee for the first year, charge $1,000 for the second year, and continually reevaluate the fee starting with the third year. Mayor Brown advised the City Council has to factor in the DSRSD Sewer Impact Fee and advised she would like to see if it can be negotiated to be paid incrementally over a series of years. In response to Councilmember Arkin, Ms. Campbell clarified this fee is collected on the City of DSRSD's behalf but it is understood at some point there will be a high fee from DSRSD. Councilmember Balch reported staff can negotiate with DSRSD to make it easier but the fee is in addition to whatever they are charging. Mayor Brown and Councilmember Narum noted it is a bargain at $100 a month. Mayor Brown noted there is a month or two where businesses cannot use the parklets due to City maintenance. In response to Councilmember Testa, Ms. Campbell confirmed the parklets could remain during the City's maintenance windows but they could not be used. Mayor Brown noted there is a City Council consensus on the City fees and phasing of the DSRSD fees. Mayor Brown noted there are processing and inspection fees in addition to the annual fee. Ms. Campbell explained those fees mirror existing fees for encroaching permits while the parklet fee matches the outdoor dining fee. Ms. Campbell confirmed City Council's direction is to waive the first year's annual fee, charge $1,000 for the second year, and evaluate future years based upon things like added maintenance costs and inflation with the subject coming back to Council. The dais unanimously agreed. Interim City Manager Dolan noted he has a list of comments made by Councilmembers varying from staff's proposal. He advised they include not allowing parklets to extend beyond a business's frontage, allowing design flexibility through design review including allowing metal, having a depth of either seven City Council Minutes Page 14 of 18 December 21, 2021
