BACKGROUND <br /> Debra Gill, Director of Human Resources and Labor Relations, is set to retire from the <br /> City of Pleasanton after 22 years of service, the past 7 years in her current capacity. <br /> Her last day of work is April 15, 2022. Xaviera Scoggins will serve has the Acting <br /> Director of Human Resources and Labor Relations for daily operational items. However, <br /> there are ongoing specialized projects and labor negotiations that require Ms. Gill's <br /> institutional knowledge and specialized skillset until a full transition can be made to a <br /> permanent Director. As such, there is a need to retain Debra Gill's services to work in a <br /> few key areas on a temporary basis while the City completes the recruitment process <br /> for her successor and onboards her permanent replacement. <br /> DISCUSSION <br /> Retired annuitants are retirees who return to work with a California Public Employees' <br /> Retirement System (CaIPERS) employer in a designated retired annuitant position. The <br /> Director of Human Resources and Labor Relations is responsible for a wide variety of <br /> complex, personnel-related programs, and issues. Because of the highly complex and <br /> regulatory-driven nature of this work, the City would benefit from retaining this employee <br /> to return to work as a designated retired annuitant to allow for a seamless transition that <br /> provides the necessary expertise and continuity of services. <br /> Government Code (GC) Sections 7522.56 and 21224 permit extra help retired <br /> annuitants under CaIPERS to be employed upon appointment by a public agency to fill <br /> a critically needed position on an interim basis before 180 days have passed. <br /> Basic requirements include: <br /> • The salary must be no more than an hourly pay rate that falls within the regular <br /> salary schedule for that position. (A retired annuitant is not entitled to any <br /> benefits, vacation, or holidays). <br /> • A maximum of 960 hours can be worked within a fiscal year (July 1 to June 30) <br /> including non-paid / volunteer hours. <br /> • Annuitant must wait 180 days after their retirement date before returning to work. <br /> Per GC 21224, "a retired person may serve without reinstatement from retirement or <br /> loss or interruption of benefits upon appointment by the appointing power of a public <br /> agency employer to prevent stoppage of public business or because the retired person <br /> has specialized skills needed in performing work of limited duration." A resolution is <br /> required to authorize this specific position for extra help retired annuitant status and for <br /> the waiver of the 180-day waiting period. <br /> Page 2 of 3 <br />
