BACKGROUND <br /> The weed abatement program, provided in Government Code Sections 39560 — 39588, <br /> establishes a mechanism for ensuring the removal of weeds, dirt, rubbish and refuse on <br /> specified properties that constitute a public nuisance. All the owners of properties <br /> included in the attached Exhibit A have been mailed a notice to abate the nuisance on <br /> their parcels. In cases where there was an insufficient mailing address, the notice was <br /> posted conspicuously on the property. The notice included the public hearing date of <br /> April 19, 2022, a deadline of May 31, 2022, and a notice that weed abatement qualifies <br /> as an essential service. Applicable weed abatement standards were also included <br /> dependent upon which type of parcel is identified. Parcels have been categorized into <br /> three areas: agricultural, parcels within the Wildland-Urban interface, and all others <br /> falling outside of these two categories. <br /> DISCUSSION <br /> At this hearing, the City Council is charged with considering the proposed abatement on <br /> the enumerated properties. Staff recommends that the City Council overrule any <br /> objections or amend the list of properties to be abated, and then order the abatement. <br /> The City Council should then adopt the attached resolution, as amended (if at all), that <br /> orders a contractor to abate the weeds on the properties attached in Exhibit A. <br /> After this hearing, fire inspectors will survey each parcel listed for compliance. If <br /> abatement has not occurred by May 31, 2022, a contractor will abate the weeds. If <br /> related litigation (e.g., an abatement warrant) is required, the property owners will be <br /> responsible not only for the abatement costs, but also all related attorneys' fees, <br /> expenses, and costs.
