Mayor Brown advised she would like bicycles and cars moved back from the parklets and supported <br /> the staffs seven-foot depth recommendation. She noted it also provides a little clearance for safety <br /> around vehicles not parked flush to the curb while people are dining on a City street. <br /> Councilmember Balch advised some of the current pop-ups egregiously protrude so he understands <br /> Mayor Brown's point about diner safety concerns. <br /> Mayor Brown reported this item may need to be bifurcated, trifurcated, or even more. <br /> Councilmember Testa reported she likes Disneyland and called for a uniform umbrella color due to their <br /> high visibility. She advised she would like to see as much solar and battery lighting as possible. <br /> In response to Mayor Brown, Ms. Campbell advised votes or feedback on each specific topic being <br /> discussed would be good. <br /> In response to Mayor Brown, the dais agreed a street lighting CIP should be conducted and, in the <br /> meantime, solar and battery-powered lighting should be required. <br /> In response to Mayor Brown, City Clerk Jocelyn Kwong advised the City Council does not need to <br /> formally vote in this. <br /> In response to Mayor Brown, Councilmember Balch supported Councilmember Arkin's suggestion to <br /> waive the annual fee for the first year, charge $1,000 for the second year, and continually reevaluate <br /> the fee starting with the third year. <br /> Mayor Brown advised the City Council has to factor in the DSRSD Sewer Impact Fee and advised she <br /> would like to see if it can be negotiated to be paid incrementally over a series of years. <br /> In response to Councilmember Arkin, Ms. Campbell clarified this fee is collected on the City of <br /> DSRSD's behalf but it is understood at some point there will be a high fee from DSRSD. <br /> Councilmember Balch reported staff can negotiate with DSRSD to make it easier but the fee is in <br /> addition to whatever they are charging. Mayor Brown and Councilmember Narum noted it is a bargain <br /> at $100 a month. Mayor Brown noted there is a month or two where businesses cannot use the parklets <br /> due to City maintenance. <br /> In response to Councilmember Testa, Ms. Campbell confirmed the parklets could remain during the <br /> City's maintenance windows but they could not be used. <br /> Mayor Brown noted there is a City Council consensus on the City fees and phasing of the DSRSD fees. <br /> Mayor Brown noted there are processing and inspection fees in addition to the annual fee. Ms. <br /> Campbell explained those fees mirror existing fees for encroaching permits while the parklet fee <br /> matches the outdoor dining fee. <br /> Ms. Campbell confirmed City Council's direction is to waive the first year's annual fee, charge $1,000 <br /> for the second year, and evaluate future years based upon things like added maintenance costs and <br /> inflation with the subject coming back to Council. The dais unanimously agreed. <br /> Interim City Manager Dolan noted he has a list of comments made by Councilmembers varying from <br /> staff's proposal. He advised they include not allowing parklets to extend beyond a business's frontage, <br /> allowing design flexibility through design review including allowing metal, having a depth of either seven <br /> City Council Minutes Page 14 of 18 December 21. 2021 <br />
