H. Program Fee <br /> 1. The Project will have a cost recovery fee program (the "Program Fee")to be paid <br /> annually. Residential users of the Project shall be required to sign up for program <br /> at an initial annual cost of$100. Payment of the Program Fee will allow the <br /> residential user access to the fill station and recycled water supply for the period <br /> during which the Project is in operation during the calendar year in which the fee <br /> was paid (e g. a"season pass"). The Parties shall meet and confer annually on the <br /> amount of the Program Fee. <br /> 2. City of Pleasanton will provide financial management services for the Project, <br /> including; <br /> a. receiving copies of invoices for all construction, operating and <br /> maintenance costs incurred by the Parties; <br /> b. establishing separate project accounts to track the expenditures, revenues, <br /> and reimbursements; <br /> c. billing the Parties for their share of the costs incurred; <br /> d. remitting reimbursements to the Party that incurred each expense; <br /> e. billing residential users and collecting the Program Fees appropriately; <br /> and <br /> f. distributing Program Fee revenues equitably to the Parties each year by <br /> December 31St. <br /> I. California Environmental Quality Act(CEQA) <br /> 1. DSRSD will be the lead agency and prepare and file any required environmental <br /> analysis for the Project pursuant to the California Environmental Quality Act <br /> ("CEQA"). <br /> 2. City of Pleasanton and City of Livermore will cooperate with DSRSD and assist <br /> DSRSD as requested in the preparation of any CEQA document and shall each act <br /> as responsible agencies as required pursuant to CEQA. <br /> 3. The Parties agree to work cooperatively to ensure Project compliance with the <br /> California Environmental Quality Act (CEQA). <br /> 4. Entering into this Agreement does not pre-determine any actions that may be <br /> required pursuant to CEQA and each Party, according to its own judgment, may <br /> take any additional actions pursuant to federal or state resource protection laws <br /> that it determines are required for its continued participation in the Project <br /> V. PROJECT OPERATION <br /> A. Recycled Water Fill Station Operations <br /> 1. To minimize traffic impacts in the City of Dublin,the fill station will only be <br /> operated 6-days per week (Tuesday— Sunday), excluding holidays, and only <br /> during non-peak traffic hours.
