body to approve conditions which may be more restrictive than normal Code standards, <br />to ensure the above objectives are met. As outlined in Exhibit A of Attachment 1 and <br />based on the information and analysis provided in this agenda report and the agenda <br />report provided to the Planning Commission on January 12, 2022, staff recommends <br />the Council make the required findings to approve the project. <br />Staff has also prepared a draft denial resolution should the Council find, aligning with <br />the Planning Commission's determination, that the in -lieu parking agreement is not <br />supportable, and the project would not be fully parked on site and cannot be approved. <br />The denial resolution is included as Attachment 7. <br />PUBLIC NOTICE <br />Notice of this hearing was sent to property owners and tenants/occupants within 1,000 <br />feet of the site. At the time of report publication, staff has received no public comments. <br />Prior to the Planning Commission hearing, staff received six public comments that noted <br />both support and concern, as seen in Attachment 6. Of note, the two adjacent property <br />owners provided letters of support for the project. <br />The project plans were also shared with the Pleasanton Downtown Association. To <br />date, staff has not received any comments. <br />ENVIRONMENTAL ASSESSMENT <br />The project is categorically exempt (Section 15301, Class 1) from the requirements of <br />the California Environmental Quality Act (CEQA). Therefore, no environmental <br />documents accompany this report. <br />SUMMARY/CONCLUSION <br />As described above and in Attachment 1, staff suggests the proposed residential unit <br />(as conditioned) will be compatible with the surrounding properties. Staff also suggests <br />the site design, building design, and massing are appropriate for the site and the Design <br />Review criteria can be met. Staff requests the Council review the proposal and hear all <br />public testimony on the project. Staff recommends the Council: <br />1. Adopt the attached resolution (Attachment 1), making the criteria for PMC <br />Section 18.20 (Design Review), approving the appeal and application P20-1053, <br />subject to the attached conditions of approval. <br />2. Approve the attached in -lieu parking agreement (Attachment 2), approving an in - <br />lieu fee for one parking space. <br />Alternatively, the Council cannot support the in -lieu parking agreement and can deny <br />the application, adopting the denial resolution (Attachment 7). <br />Page 8 of 9 <br />
