In -Lieu Parking Agreement <br />PMC Section 18.88.120 states owners of a parcel or parcels within the Downtown <br />Revitalization District who are unable to provide all of the off-street parking required by <br />the PMC apply to the City for an in -lieu parking agreement. Said in -lieu agreements are <br />approved ministerially by the Community Development Director if the new construction <br />provides at least 85 percent of its required parking on-site and expansions to existing <br />buildings are less than or equal to 25 percent of the building's existing floor area. <br />In -lieu parking agreements for new construction which provides less than 85 percent of <br />its required parking on site and expansions to existing buildings which exceed 25 percent <br />of the building(s) existing floor area are subject to the approval of the City Council. The <br />City Council may grant or deny the request. This project expands the total floor area on <br />the lot by more than 25 percent, so the in -lieu agreement requires approval by the City <br />Council. <br />Among the scope of duties for reviewing bodies outlined in Chapter 8.20 — Design Review, <br />is to "conform the project to the goals and policies of the general plan, and any relevant <br />specific plan, and/or the purposes and objectives of the zoning district." Approval of the <br />in -lieu agreement is necessary for the project to conform with the parking requirements <br />of the PMC, and therefore for the Design Review application to be approved. <br />Pursuant to the PMC, if approved, the in -lieu parking agreement would require the <br />applicant to pay the established in -lieu parking fee for a surface parking space. The <br />currently adopted fee is $21,940.53 per parking space (updated for 2022). Staff concludes <br />(consistent with past in -lieu approvals, including one on the subject site in 2002), the in - <br />lieu parking agreement, Attachment 2, should be approved. <br />Design Review Criteria <br />PMC Section 18.20 sets forth Design Review Criteria. The criteria are as follows: <br />• Preservation of the natural beauty of the city and the project site's relationship to <br />it <br />• Appropriate relationship of the proposed building to its site, including transition <br />with streetscape, public views of the buildings, and scale of buildings within its <br />site and adjoining buildings <br />• Appropriate relationship of the proposed building and its site to adjoining areas, <br />including compatibility of architectural styles, harmony in adjoining buildings, <br />attractive landscape transitions, and consistency with neighborhood character <br />• Preservation of views enjoyed by residents, workers within the city, and <br />passersby through the community <br />• Architectural style, as a function of its quality of design and relationship to its <br />surroundings; the relationship of building components to one another/the <br />building's colors and materials <br />Note that, even though a proposed project may comply with applicable zoning <br />standards (e.g., setbacks, height limits) the Design Review process allows the reviewing <br />Page 7 of 9 <br />
