ATTACHMENT 1 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING AN APPLICATION FOR A DESIGN REVIEW AT 218 RAY STREET, AS FILED UNDER CASE NOS. P20-1053 WHEREAS, on December 18, 2020, Wassim Naguib applied for Design Review (DR) approval to construct a new 1,069 square -foot two-story residential unit behind an existing commercial building located at 218 Ray Street, and WHEREAS, zoning for the property is C -C (Central Commercial) District and is within the Downtown Revitalization, Core Area Overlay, and Downtown Specific Plan area; and WHEREAS, the new building and exterior site modifications require Design Review approval; and WHEREAS, pursuant to the Pleasanton Municipal Code, the project would provide one fewer parking space than required, and therefore approval of an in -lieu parking agreement for the project is necessary; and WHEREAS, the project is categorically exempt (Section 15301, Class 1) from the requirements of the California Environmental Quality Act (CEQA); WHEREAS, on August 26, 2020, the Planning Commission held a duly -noticed workshop and discussed the project and provided feedback on the application; WHEREAS, at its meeting on December 8, 2021, the Planning Commission held a duly - noticed public hearing and continued the project, without discussion, to January 12, 2022; and WHEREAS, on January 12, 2022, the Planning Commission held a public hearing having considered relevant exhibits, recommendations of the City staff, and public testimony, and denied the application by a vote of 3-2; and WHEREAS, on January 27, 2022, the applicant appealed the Planning Commission's determination; and WHEREAS, on March 1, 2022, the City Council held a public hearing having considered relevant exhibits, determination of the Planning Commission, recommendations of City staff, and public testimony, and approved the required in -lieu parking agreement and the subject application. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: Section 1: Findings for Design Review Approval (P20-1053)
