the frontage of 3520 Dennis Drive as shown on Exhibit B for review and approval by the <br /> City Engineer. Phase 2: Once improvement plans are approved,hire contractor(s) <br /> licensed by the State of California who possess either an"A"-General Engineering <br /> Contractor license or"C"-Specialty Contractors license(e.g. C-8 Concrete Contractor, <br /> C-12 Earthwork and Paving Contractor, etc.). Said contractor(s) shall construct the <br /> improvements represented on the approved improvement plans in accordance with a <br /> City-issued Encroachment Permit per Pleasanton Municipal Code Chapter 13.04, <br /> although inspection fees will be waived pursuant to Section 3 below. <br /> All of said work shall be done and materials furnished in strict accordance with the <br /> approved plans and in accordance with the City of Pleasanton's Standard Specifications and <br /> Details(November 2016). It is further understood that the work and materials shall be under the <br /> supervision of the Owners and City Engineer, and performed and installed to the Owners and <br /> City Engineer's satisfaction. <br /> No financial security is required for the work described in this Agreement. The estimated <br /> value of said work is $70,000. <br /> 2. Time of Essence. Time is of the essence in the performance of this Agreement. <br /> The 3520 Dennis Drive Improvements required by this Agreement shall be completed by Owners <br /> prior to occupancy of the new single-family home to be constructed on the Property. <br /> The City may extend the time for completion of improvements hereunder, upon good <br /> cause being shown by the Owners. <br /> 3. Inspection and Acceptance. City shall inspect all of said work through an <br /> inspector employed by City at the cost and expense of City.After completion of the work and <br /> final inspection,the City Engineer shall accept the work as complete and release the Owners and <br /> their contractor from all future liability. <br /> 4. Reimbursement. Once Phase 1 is accomplished according to Section 1 above, <br /> Owners will be eligible for reimbursement by City for design-related costs. Owners shall submit <br /> copies of written invoices to the City Engineer or designee for review and reimbursement. If the <br /> project does not progress beyond design,Owners shall submit both printed and digital copies of <br /> the 3520 Dennis Drive Improvement plans to City in formats compatible with City's current <br /> software systems. Assuming the project progresses to Phase 2, City shall reimburse Owners for <br /> the reasonable cost of construction and construction support, as well as financing costs(e.g. <br /> reasonable loan fees and interest paid, prorated as applicable). Owners will submit copies of <br /> written invoices to the City Engineer or designee for review and reimbursement. <br /> 5. Insurance and Indemnification by Contractor. Prior to initiating Phase 2, Owners <br /> shall have Owners' contractor: (a) execute the attached Indemnification as set forth in Exhibit A <br /> to indemnify City,and(b)provide the following insurance: <br /> Public Improvement Agreement—3520 Dennis Drive Page 2 of 8 <br />
