ATTACHMENT 2 <br /> � V OF <br /> .'\Issomem d <br /> PUBLIC IMPROVEMENT AGREEMENT ""° _r`^' "' "' <br /> Public Right-of-Way Improvements at 3520 Dennis Drive �'L-E 7SANTOIL <br /> This Public Improvement Agreement(the"Agreement") is made and entered into this <br /> 15th day of December,2021, by and between Robert Edward Borchers and Beth Suzanne <br /> Borchers,Trustees of The Borchers Family Revocable Trust dated 6-21-2006(collectively the <br /> "Owners")and the City of Pleasanton,a municipal corporation(the "City"). <br /> RECITALS <br /> WHEREAS, Owners have a City-approved entitlement(Ordinance No. 2223,PUD-140, <br /> and VTPM 11110 effective on November 4,2021)for subdivision of land,construction of a <br /> custom single-family home,and related site improvements at 2207 Martin Avenue,APN <br /> 946-1146-46 (the"Property"),which includes the creation of a new lot taking access from <br /> Dennis Drive and the requirement to construct frontage improvements, including curb,gutter and <br /> sidewalk and other public improvements(the "Public Improvements")along the length of the <br /> Property on Dennis Drive;and <br /> WHEREAS,to create continuity of the Public Improvements along Dennis Drive,the <br /> Owners have agreed to construct public right-of-way improvements on the previously dedicated <br /> Dennis Drive frontage of the adjacent northerly property to be located within the "Dennis Drive <br /> Offer of Dedication"area and"PSE"(Public Service Easement)dedicated to City on the final <br /> map for Parcel Map 8291 (Book 288 of Maps at Pages 15-16,Alameda County Recorder's <br /> Office)and at a location commonly known as 3520 Dennis Drive,APN 946-1146-50,as shown <br /> in Exhibit B (collectively the"3520 Dennis Drive Improvements"); and <br /> WHEREAS, Owners intend to dedicate such 3520 Dennis Drive Improvements to the <br /> City upon their completion; and <br /> WHEREAS, City shall reimburse Owners for the reasonable cost of the design and <br /> construction of the 3520 Dennis Drive Improvements because the persons who created 3520 <br /> Dennis Drive by Parcel Map 8291 previously deposited with the City funds for such 3520 <br /> Dennis Drive Improvements to be paid when the 3520 Dennis Drive Improvements were built. <br /> NOW,THEREFORE, in consideration of the faithful performance of the promises,terms, <br /> conditions and covenants set forth herein by Owners for the entitlement approval of their <br /> subdivision of land,construction of a custom single-family home, and related site improvements, <br /> the parties hereto agree as follows: <br /> 1. Work. Owners will do or cause to be done and performed the following described <br /> work: Phase 1: Hire a California-licensed civil engineer and/or land surveyor to develop <br /> improvement plans for curb, gutter and sidewalk within the public right-of-way across <br /> Public Improvement Agreement-3520 Dennis Dove Page I of 8 <br />
