ATTACHMENT 2 � V OF .'\Issomem d PUBLIC IMPROVEMENT AGREEMENT ""° _r`^' "' "' Public Right-of-Way Improvements at 3520 Dennis Drive �'L-E 7SANTOIL This Public Improvement Agreement(the"Agreement") is made and entered into this 15th day of December,2021, by and between Robert Edward Borchers and Beth Suzanne Borchers,Trustees of The Borchers Family Revocable Trust dated 6-21-2006(collectively the "Owners")and the City of Pleasanton,a municipal corporation(the "City"). RECITALS WHEREAS, Owners have a City-approved entitlement(Ordinance No. 2223,PUD-140, and VTPM 11110 effective on November 4,2021)for subdivision of land,construction of a custom single-family home,and related site improvements at 2207 Martin Avenue,APN 946-1146-46 (the"Property"),which includes the creation of a new lot taking access from Dennis Drive and the requirement to construct frontage improvements, including curb,gutter and sidewalk and other public improvements(the "Public Improvements")along the length of the Property on Dennis Drive;and WHEREAS,to create continuity of the Public Improvements along Dennis Drive,the Owners have agreed to construct public right-of-way improvements on the previously dedicated Dennis Drive frontage of the adjacent northerly property to be located within the "Dennis Drive Offer of Dedication"area and"PSE"(Public Service Easement)dedicated to City on the final map for Parcel Map 8291 (Book 288 of Maps at Pages 15-16,Alameda County Recorder's Office)and at a location commonly known as 3520 Dennis Drive,APN 946-1146-50,as shown in Exhibit B (collectively the"3520 Dennis Drive Improvements"); and WHEREAS, Owners intend to dedicate such 3520 Dennis Drive Improvements to the City upon their completion; and WHEREAS, City shall reimburse Owners for the reasonable cost of the design and construction of the 3520 Dennis Drive Improvements because the persons who created 3520 Dennis Drive by Parcel Map 8291 previously deposited with the City funds for such 3520 Dennis Drive Improvements to be paid when the 3520 Dennis Drive Improvements were built. NOW,THEREFORE, in consideration of the faithful performance of the promises,terms, conditions and covenants set forth herein by Owners for the entitlement approval of their subdivision of land,construction of a custom single-family home, and related site improvements, the parties hereto agree as follows: 1. Work. Owners will do or cause to be done and performed the following described work: Phase 1: Hire a California-licensed civil engineer and/or land surveyor to develop improvement plans for curb, gutter and sidewalk within the public right-of-way across Public Improvement Agreement-3520 Dennis Dove Page I of 8
