Section 3. The City Council finds that the Management District Plan <br /> satisfies all requirements of Streets and Highways Code § 36622. <br /> Section 4. The City Council declares its intention to renew the TVTMD <br /> and to levy and collect assessments on all lodging businesses, existing and in the <br /> future, with five (5) rooms or more within the TVTMD boundaries pursuant to the <br /> Property and Business Improvement District Law of 1994. <br /> Section 5. The TVTMD shall include all lodging businesses with five (5) <br /> rooms or more located within the the boundaries of the cities of Dublin, Livermore, <br /> and Pleasanton, the Town of Danville, and those portions of the unincorporated <br /> areas of Contra Costa and Alameda Counties, which include the communities of <br /> Alamo, Blackhawk, and Sunol, the portion of the counties that lies between the <br /> cities of Pleasanton and Livermore, and that portion of Alameda County which lies <br /> southeast of Interstate 580, as shown on the map attached as Exhibit B. <br /> Section 6. The name of the district shall be Tri-Valley Tourism Marketing <br /> District (TVTMD). <br /> Section 7. The annual assessment rate is three dollars and twenty-five <br /> cents ($3.25) of gross short-term room rental revenue. Based on the benefit <br /> received, assessments will not be collected on: stays of more than thirty (30) <br /> consecutive days, nor on stays by any Federal or State of California officer or <br /> employee when on official business who makes a claim that they are exempt, nor <br /> on stays by any officer or employee of a foreign government who is exempt by <br /> reason of express provision of federal law or international treaty. The annual <br /> assessment rate may be subject to an increase each year starting in the third year, <br /> the amount of which shall be determined by the Visit Tri-Valley Board, as described <br /> in the Plan. The total assessment rate may not exceed four dollars ($4.00). <br /> Section 8. The assessments levied for the TVTMD shall be applied <br /> toward sales & marketing and destination development programs to market <br /> assessed businesses in the Tri-Valley area as tourist, meeting, and event <br /> destinations, as described in the Plan. Funds remaining at the end of any year <br /> may be used in subsequent years in which TVTMD assessments are levied as <br /> long as they are used consistent with the requirements of this resolution and the <br /> Plan. <br /> Section 9. The TVTMD will have a ten-year term, beginning on July 1, <br /> 2022, and end on June 30, 2032, unless renewed pursuant to Streets and <br /> Highways Code § 36660. <br /> Section 10. Bonds may be issued. <br /> Section 11. The time and place for the public meeting to hear testimony <br /> on establishing the TVTMD and levying assessments are set for March 15, 2022, <br />
