CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-048 <br /> <br />RESOLUTION DENYING THE APPEAL OF CASE PAP-65, THEREBY <br />APPROVING THE APPLICATION OF TONY PERINO/NEARON <br />ENTERPRISES, FOR MINOR SUBDIVISION APPROVAL, AS FILED <br />UNDER CASE PMS-27 <br /> <br />WHEREAS, <br /> <br />Tony Perino/Nearon Enterprises has applied for minor subdivision approval <br />to subdivide an approximately 10.5-acre parcel located at 5725 West Las <br />Positas Boulevard into two lots measuring approximately 5.5 acres and <br />5.0 acres, respectively; and <br /> <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - <br /> Industrial/Commercial-Office) District; and <br /> <br />WHEREAS, <br /> <br />the Zoning Administrator, after having considered all relevant exhibits and <br />recommendations of City staff concerning this application, approved the <br />application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, an appeal to <br /> the decision of the Zoning Administrator was submitted; and <br /> <br />WHEREAS, <br /> <br />at its meeting of June 15, 2004, the City Council received a report from the <br />Director of Planning and Community Development, together with a copy of <br />the staff report to the Planning Commission, regarding this matter; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public heating on June 15, 2004, at which time the <br />applicant and any other member of the public was offered an oppommity to <br />present evidence regarding this appeal; and <br /> <br />WHEREAS, <br /> <br />after a review of the materials presented, the City Council determined that <br />the proposed minor subdivision, as conditioned, is appropriate and is <br />consistent with the zoning regulations for the zoning district of the <br />property. <br /> <br /> <br />
