CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-046 <br /> <br />RESOLUTION UPHOLDING THE APPEAL OF CASE PAP-64, THEREBY <br />APPROVING THE APPLICATION OF ROBERT J. SCHMITZ, <br />COR-O-VAN MOVING & STORAGE, FOR CONDITIONAL USE PERMIT <br />APPROVAL, AS FILED UNDER CASE PCUP-109 <br /> <br />WHEREAS, <br /> <br />Robert J. Schmitz, Cor-O-Van Moving & Storage, has applied for <br />conditional use permit approval to operate a moving and storage facility at <br />5555 Sunol Boulevard; and <br /> <br />WHEREAS, zoning for the property is I-P (Industrial Park) District; and <br /> <br />WHEREAS, <br /> <br />at its meeting of May 12, 2004, the Planning Commission, after having <br />considered all public testimony, relevant exhibits, and recommendations of <br />City staff concerning this application, denied the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant <br /> submitted an appeal to the decision of the Planning Commission; and <br /> <br />WHEREAS, <br /> <br />at its meeting of June 15, 2004, the City Council received a report from the <br />Director of Planning and Community Development, together with a copy of <br />the staff report to the Planning Commission, regarding this matter; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public heating on June 15, 2004, at which time the <br />applicant and any other member of the public were offered an opportunity <br />to present evidence regarding this appeal; and <br /> <br />WHEREAS, <br /> <br />after a review of the materials presented, the City Council determined that <br />the proposed conditional use, as conditioned, is appropriate for the site and <br />is consistent with the zoning regulations for the zoning district of the <br />property. <br /> <br /> <br />
