However, in this case, to ensure that the environmental design considerations are taken into account and that construction activities themselves don't cause erosion, Dudek will design a robust SWPPP and include it in the project plans. To include the mitigation in the environmental documentation and project plans and to prepare the SWPPP, staff recommends City Council approve a second amendment to the agreement with Dudek in the not-to-exceed amount of $21,865. When the design and environmental clearance are complete, the project will be competitively bid for construction. One of the primary reasons staff originally planned on bidding the design and construction together as one contract is because it is believed that obtaining the environmental clearances necessary to construct the trail is more difficult and more expensive than actually constructing the trail. Costs to date, as well as the estimated cost of construction to come, confirm this belief. Therefore, while there is only approximately $40,000 remaining of the $130,000 budgeted for the project, and closing and replanting the "unofficial" trails was not considered in the original budget, no changes to the project budget are recommended at this time. However, due to the additional environmental requirements during construction, the budget will need to be addressed when staff recommends City Council award the project after bids are received.
