Based on Council comments and questions, staff is supportive of the following <br /> amendments to the MOU. Added language is red in color. <br /> Page 4 The CITY and DISTRICT will provide an annual update at the joint City <br /> Council/School Trustee meeting to the governing bodies. The CITY will receive updates <br /> during the Police Department's bi-annual report to Council. <br /> Page 3 14. The DISTRICT and the CITY agree that the school discipline of students is <br /> the responsibility of the site and DISTRICT administration and preventing and <br /> investigating crime is the responsibility of the SRO. The DISTRICT administration will <br /> not rely on the SRO for assistance in handling school discipline to include non-criminal <br /> bullying and harassment. The CITY and DISTRICT'S school administration will <br /> collaborate to work in the best interest of the student and the student body. CITY will <br /> document and investigate all incidents of crime pursuant to Pleasanton Police <br /> Department policies and procedures. School discipline pertaining to the safety of the <br /> school site may be shared with the SRO. This includes but is not limited to students <br /> who are prohibited from campus due to suspension or expulsion or discipline relating to <br /> school violence. <br /> Page 8 The SRO, when possible, will make the physical arrest, including handcuffing, of <br /> students outside the presence of other non-involved students. The objective is to <br /> preserve the privacy of juveniles. <br /> Page 8 addition Prior to a custodial interrogation, and before the waiver of any Miranda <br /> rights, a youth 17 years of age or younger shall consult with legal counsel. The <br /> consultation may not be waived by the youth or their parent. <br />
