ATTACHMENT #1 Contract # 2019484 SECOND AMENDMENT TO AGREEMENT This Second Amendment to Agreement ("Second Amendment") is entered into this day of November 2021 by the City of Pleasanton ("City") and Harvey Electric ("Contractor"). Whereas, on July 01, 2019, the City and Contractor entered into an As -Needed Maintenance and Trade Services Agreement for Electrical Services Repair for City buildings and structures and on April 22, 2021, by the First Amendment to increase compensation to $200,000 for fiscal year 2020/21 and a cumulative Work Authorization shall not exceed $500,000 (collectively the "Agreement"); and Whereas, the parties desire to amend the Agreement to increase the not to exceed compensation for the remaining term of the Agreement. Now, therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: The first sentence of Section 3 of the Agreement, "Compensation" is amended to read: "Total Compensation pursuant to this Agreement for all cumulative Work Authorization shall not exceed $700,000 for the term of this agreement." 2. All other terms and conditions of the Agreement shall remain in full force and effect.
