BACKGROUND <br />On October 17, 2006, City Council adopted Ordinance 1942, approving the rezoning of <br />an approximately 30 -acre hillside parcel located at 3459 Old Foothill Road from an <br />agriculture district to a PUD-LDR district on eight acres, and to a PUD-OS/AG district on <br />the remaining 22 acres. At the same meeting, City Council approved the application for <br />a Planned Unit Development (PUD) to subdivide eight acres into eight custom home <br />lots and to deed the remaining 22 acres for permanent open space. <br />On May 23, 2007, the City's Planning Commission adopted Resolution No. PC -2007-25, <br />approving Vesting Tentative Tract Map 7813 and consistent with City Council's approval <br />of the PUD for the property. <br />On December 8, 2014, the 22 -acre open space parcel was transferred to the City of <br />Pleasanton and recorded with the Alameda County Clerk -Recorder's Office. <br />On March 3, 2020, City Council approved the final map, improvement plans (including <br />the proposed trail plans for the open space parcel and acceptance of funding in the <br />amount of $57,397 from the developer for trail construction), subdivision agreement, <br />and easement and maintenance agreement for Tract 7813 at 3459 Old Foothill Road. <br />Construction of the development improvements soon followed and are currently <br />underway. <br />In September 2021, staff updated the trail plans and created the specifications so that <br />the project met public contract code requirements. The project was advertised for <br />construction bid in early October 2021, with a bid opening time and date established as <br />2 p.m. on October 21, 2021. <br />DISCUSSION <br />A critical component of this trail project is working with a contractor that has expertise in <br />constructing natural surface trails. Natural surface trail construction is a specialized skill. <br />It requires an understanding of grading, erosion, ideal hiking slopes, and use of existing <br />materials and site features to construct a trail that is sustainable, won't require <br />significant maintenance, and that is thoroughly enjoyed by users. For that reason, the <br />City required that membership in the Professional Trailbuilder's Association (PTBA) be <br />a contract requirement. The PTBA has been in existence for more than 45 years and is <br />an organization of companies that are experts in design, mapping, and construction of <br />trails. Members that are contractors must have demonstrated trail construction <br />experience. <br />Five contractors submitted a bid for the Meadowlark Trail Project by the bid deadline of <br />2 p.m. on Thursday, October 21, 2021. The Engineer's Estimate for the project was <br />$50,000. <br />Bids ranged from the low bid of $46,500 from US Engineering, Inc. to a high bid of <br />$152,640 from the Brannon Corporation. See Attachment 2 for the Bid Summary. In <br />reviewing the bids, staff determined that US Engineering, Inc., Kerex Engineering, and <br />the Brannon Corporation did not possess the necessary natural surface trail <br />Page 2of3 <br />
