7. Vehicle Allowance/Cell Phone. Dolan may select either a car allowance of $400 monthly, or a vehicle furnished by the City. Dolan shall have the exclusive and unrestricted use of such vehicle, but is shall not be driven by any members of Dolan's family. Dolan shall pay for his own gasoline. The City shall insure and register such vehicle. If Dolan is involved in an automobile accident for which Dolan is determined to have been at fault, Dolan shall pay any deductible to repair such vehicle. City shall also provide Dolan with a cell phone and pay all charges related to City business. 8. Termination. Dolan serves as Interim City Manager at the pleasure of the City Council and City may terminate this Contract at any time. 9. Reinstatement as Assistant City Manager ("ACM"). Dolan may, upon giving the City 30 days' advance written notice, resign his position as Interim City Manager. If City terminates this contract, or if Dolan resigns his position as Interim City Manager, he shall return to the position of and be reinstated as the ACM. Upon his reinstatement as the ACM, he shall enjoy those benefits set forth in and be subject to the terms and conditions of the Management Compensation Plan. In the event that Dolan returns to the position of and is reinstated as the ACM, Dolan's salary and benefits shall be adjusted to match that which would have been in effect at the time he is so reinstated had he not entered into this Contract and had, during the term of this Agreement, retained and performed the duties of his position as ACM. Any benefits or rights that he enjoyed as the Interim City Manager under this Contract shall terminate upon his resumption of his ACM position. Under such circumstances, it shall be presumed that during the term of this Contract Dolan did not and would have not received any salary merit increases as the ACM as a result of any performance evaluations (known as compa-ratio increases) and will only be entitled to control point and cost -of -living increases provided to others covered by the Management Compensation Plan. 10. General Provisions. This Contract constitutes the entire agreement between City and Dolan. This Contract shall be effective upon its execution. If any provision or portion of this Contract is held invalid or unenforceable, the remainder of the Contract shall deemed severable, shall not be affected, and shall remain in full force and effect.
