RECEIVED <br /> September 17,2021 <br /> September 17, 2021 <br /> P21-0820 <br /> Planning Commission <br /> City of Pleasanton CITY OF PLEASANTON <br /> 200 Old Bernal Avenue PLANNING DIVISION <br /> PO Box 520 EXHIBIT B <br /> Pleasanton, CA 94566 <br /> Subject:Appeal of Staff Denial(560 Main Street) <br /> Case P21-0820 <br /> Honorable Chair and Members of the Commission: <br /> This letter,and the appeal form filed with Planning, is to serve as my appeal to the Director of <br /> Community Development's determination to deny a requested exception to the Active Ground Floor <br /> Use Overlay requirements for my business at 560 Main Street. <br /> This letter,and my appeal generally, is consistent with an appeal approved recently by the Commission <br /> for a business immediately adjacent to mine at 550 Main Street. In some respects, I believe my appeal <br /> goes further into the heart of compliance as detailed below. <br /> Background <br /> This case is a result of COVID,which caused the prior tenant of 560 Main Street, a children's clothing <br /> store,to close and terminate its lease for the space. In August 2020, 14 months ago, I signed a lease for <br /> 560 Main and began setting up my shop. My prospective launch was in stark contrast to many retail and <br /> other businesses downtown that were closing under government order or because of COVID and the <br /> associated business climate. <br /> This Business <br /> My landlord was unaware,and I was uninformed prior to signing my lease,that personal service <br /> businesses had been recently restricted by the City of Pleasanton. Once this was communicated to me, I <br /> invested an additional$25,000 to partition my boutique retail shop more definitively from my body <br /> sculpting operation. You may recall that no such physical partition was required or erected for the <br /> mixed-use exception this Commission granted next door. <br /> I also diversified the product offerings available (see attached photos) in my retail shop to make it clear <br /> these offerings went far beyond the scope of products my sculpting clients would likely purchase. <br /> posted regular business hours of 11:00am to 6:00pm Tue-Fri and 12:00 noon to 5:00 pm Saturday, <br /> painted on the front door. I installed a point-of-sale checkout counter. I obtained a Reseller's Permit for <br /> the shop from the California Department of Tax and Fee Administration. The <br /> front building is a multi-tenant, one- and two-story structure with the two-story portion adjacent <br /> to Main Street, stepping down to one-story behind. The other building on the subject site is a <br /> one-story, single-tenant building. A private parking lot is located at the rear of the property and <br /> has seven parking spaces. The appellant's tenant space is located on the ground floor of the <br /> front building and the tenant space is approximately 1,065 square feet.
