Use requirement, for a personal service use with a retail component within a ground floor <br /> tenant space, since the proposed business would not meet the requirements of the Pleasanton <br /> Municipal Code in order to qualify as an multi-use active ground floor use, in that the front <br /> portion of the tenant space would not function as a bona fide retail shop independent of the <br /> personal service use to which it is attached, and none of the requisite criteria for approval of an <br /> exception, including the necessary period of vacancy, would have been met. <br /> Section 2: <br /> This resolution shall become effective 15 days after its passage and adoption unless appealed <br /> prior to that time. <br /> PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of <br /> Pleasanton at a regular meeting held on October 13, 2021, by the following vote: <br /> Ayes: Commissioners <br /> Noes: Commissioners <br /> Absent: Commissioners <br /> Abstain: Commissioners <br /> ATTEST: <br /> Melinda Denis Justin Brown <br /> Secretary, Planning Commission Chair <br /> APPROVED AS TO FORM: <br /> Julie Harryman <br /> Assistant City Attorney <br /> P21-0820 Planning Commission <br /> Page 2 of 2 <br />ptsations, re-applied for a Zoning <br /> Certificate requesting approval for a personal service use with a retail component within a <br /> ground floor tenant space, intended to conform with the Active Ground-Floor Use Overlay <br /> requirements for a tenant space located at 560 Main Street; and <br /> WHEREAS, on September 2, 2021 the Director of Community Development issued a <br /> denial of the application, finding the criteria specified to allow the use within the C-C (Central <br /> Commercial), Active Ground-Floor Overlay District and Downtown Specific Plan would not be <br /> met and also finding that the criteria for an exception could not be met; and <br /> WHEREAS, zoning for the property is C-C (Central Commercial), Active Ground-Floor <br /> Overlay District and located in the Downtown Specific Plan; and <br /> WHEREAS, within the Active Ground-Floor Overlay District personal service uses are <br /> not a permitted use on the ground floor, except as a component of a multi-use occupancy <br /> where an active use occupies the first 25-percent of the depth of tenant space, or where <br /> certain other criteria allow for a specific exception to be granted; and <br /> WHEREAS, on October 13, 2021 the Planning Commission held a duly-noticed public <br /> hearing and considered relevant exhibits, recommendations of the City staff concerning this <br /> request, and received testimony from the applicant and interested parties. <br /> NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br /> Pleasanton, based on the entire record of proceedings, including the oral and written staff <br /> reports and all public comment and testimony: <br /> Section 1: <br /> The Planning Commission hereby denies the request of Erica Jasso, Sculptsations, for an <br /> Zoning Certificate and related determination as to conformance with the Active Ground-Floor <br />his report. <br /> Primary Author: <br /> Melinda Denis, Planning and Permit Center Manager, 925-931-5631 or mdenis@cityofpleasantonca.gov <br /> P21-0820, 560 Main Street Planning Commission <br /> 9 of 9 <br /><br /> P21-0820, 560 Main Street Planning Commission <br /> 6 of 9 <br />reet. The <br /> front building is a multi-tenant, one- and two-story structure with the two-story portion adjacent <br /> to Main Street, stepping down to one-story behind. The other building on the subject site is a <br /> one-story, single-tenant building. A private parking lot is located at the rear of the property and <br /> has seven parking spaces. The appellant's tenant space is located on the ground floor of the <br /> front building and the tenant space is approximately 1,065 square feet.
