<br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
<br /> APPROVING THE REQUEST OF ERICA JASSO, SCULPTSATIONS, FOR A ZONING
<br /> CERTIFICATE AND RELATED DETERMINATION AS TO CONFORMANCE WITH THE
<br /> ACTIVE GROUND FLOOR USE REQUIREMENT, FOR A RETAIL AND PERSONAL
<br /> SERVICE MULTI-USE IN A GROUND-FLOOR TENANT SPACE LOCATED AT 560 MAIN
<br /> STREET, AS FILED UNDER CASE NO. P21-0820
<br /> WHEREAS, on May 18, 2021 Erica Jasso, Sculptsations, applied for a Zoning
<br /> Certificate requesting approval for a personal service use with a retail component within a
<br /> ground floor tenant space, intended to conform with the Active Ground-Floor Use Overlay
<br /> requirements for a tenant space located at 560 Main Street; and
<br /> WHEREAS, on June 7, 2021 the Zoning Administrator issued a denial of the
<br /> application, finding the criteria specified to allow the use within the C-C (Central Commercial),
<br /> Active Ground-Floor Overlay District and Downtown Specific Plan would not be met and also
<br /> finding that the criteria for an exception could not be met; and
<br /> WHEREAS, on August 5, 2021 Erica Jasso, Sculptsations, re-applied for a Zoning
<br /> Certificate requesting approval for a personal service use with a retail component within a
<br /> ground floor tenant space, intended to conform with the Active Ground-Floor Use Overlay
<br /> requirements for a tenant space located at 560 Main Street; and
<br /> WHEREAS, on September 2, 2021 the Director of Community Development issued a
<br /> denial of the application, finding the criteria specified to allow the use within the C-C (Central
<br /> Commercial), Active Ground-Floor Overlay District and Downtown Specific Plan would not be
<br /> met and also finding that the criteria for an exception could not be met; and
<br /> WHEREAS, zoning for the property is C-C (Central Commercial), Active Ground-Floor
<br /> Overlay District and located in the Downtown Specific Plan; and
<br /> WHEREAS, within the Active Ground-Floor Overlay District, personal service uses are
<br /> not a permitted use on the ground floor, except as a component of a multi-use occupancy
<br /> where an active use occupies the first 25-percent of the depth of tenant space; and
<br /> WHEREAS, retail uses are a permitted use in the C-C (Central Commercial, Active
<br /> Ground-Floor Overlay District) and Downtown Specific Plan, and the proposed use would
<br /> incorporate a retail component within the first 32-percent of the depth of tenant space, with the
<br /> personal service use occupying the remainder; and
<br /> WHEREAS, the project is categorically exempt from the California Environmental
<br /> Quality Act (CEQA) pursuant to Section 15301, Class 1, Existing Facilities; and
<br /> WHEREAS, on October 13, 2021 , the Planning Commission held a duly-noticed public
<br /> hearing and considered relevant exhibits, recommendations of the City staff concerning this
<br /> request, and received testimony from the applicant and interested parties.
