9 <br /> THE CITY OF <br /> �LAA"fTO1C CITY COUNCIL AGENDA REPORT <br /> October 5, 2021 <br /> Engineering <br /> TITLE: ACCEPT PUBLIC IMPROVEMENTS PERFORMED BY PONDEROSA <br /> HOMES II, INC. FOR TRACT 8317 LOCATED AT 1851 ROSE AVENUE <br /> SUMMARY <br /> PUD-99 and Tract 8317 created 16 single-family lots and one remainder parcel with <br /> future subdivision potential for three additional lots on an approximately 9-acre site <br /> located at the west end of Rose Avenue as shown on Attachment 1 . This subdivision is <br /> governed by both a Development Agreement (Ordinance 2142) and a Subdivision <br /> Improvement Agreement with corresponding surety bonds. The developer, Ponderosa <br /> Homes II, Inc., also constructed off-site public water and sanitary sewer improvements <br /> through Alameda County Fairgrounds and Zone 7 properties under a separate Off-Site <br /> Improvement Agreement and Reimbursement Agreement, as previously accepted in <br /> 2018. Ponderosa has now completed the required subdivision improvements and has <br /> requested formal acceptance of the public infrastructure for city maintenance. Staff has <br /> inspected the work and determined that the improvements are complete and ready for <br /> acceptance. <br /> RECOMMENDATION <br /> 1. Accept public improvements constructed for Tract 8317 90 calendar days after this <br /> action pursuant to California Government Code §66499.7. <br /> 2. Authorize the City Clerk to release the Subdivision Performance Bond and the <br /> Subdivision Labor and Materials Bond 90 calendar days after this action, assuming <br /> no liens are filed. Authorize the City Clerk to release the Maintenance Bond one year <br /> after this action, assuming no latent defects are discovered. <br /> FINANCIAL STATEMENT <br /> There will be a minimal increase to the budget for the maintenance of public <br /> improvements. Tax revenue generally covers the increased cost to provide services and <br /> maintain infrastructure. <br />
